<br />AMENDMENT TO ORDINANCE <br />#779 <br /> <br />Councilman Cummings <br />Subdivision Fees - Older <br />Part of Town <br /> <br />Councilman Morris <br />4 Members of Board Required <br />to Approve Variances and <br />Overturn Decision of Zoning <br />Administrator <br /> <br />Retaining Walls <br /> <br />1/18/83 <br /> <br />Page -5- <br /> <br />Councilwoman Morris moved, Councilman Leary <br />seconded that Ordinance #779 read none of the <br />members of the Board of Adjustments and Appeals <br />may be current members of the city Planning <br />Commission. Question called for. 6 Ayes <br />1 Nay - Councilman Cummings dissenting. <br />Motion carried. <br /> <br />Inquired on the provision regarding the <br />subdivision process before the building per- <br />mit is issued, would the fees for the sub- <br />division process be in addition to the <br />building permit fee. <br />Director Rupp advised they would be. <br />Cummings asked on a lot of approximately <br />1500 sq. ft. what would the fee be in the <br />older part of town? <br />Director Rupp advised $500 - $600 in addition <br />to the building permit fee. <br /> <br />Referred to section 17.48.060 of the ordinance <br />and stated there are 5 members on the Board <br />of Adjustments - inquired if there was a <br />specific reason why 4 members of the board <br />is required to approve variances and to <br />overturn decisions of the zoning administrator <br />rather than a majority vote. <br />Attorney Rautenstraus advised that state <br />statues requirE:d that those two items require <br />4 members, and the number on the Board is <br />set by State Statutes. <br /> <br />Councilwoman Morris then referred to section <br />17.52.090 - shall not include fences, flag <br />poles, or retaining walls - how was this <br />determined? <br />Rautenstraus advised the reason was to <br />determine circumstances where a permit is <br />required, but did not apply to the subdivision <br />process. <br />Councilwoman Morris commented retaining walls <br />were a concern of both the Planning Commission <br />and councilmembers when Mr. Caranci's project <br />was presented, could retaining walls just be <br />constructed with a building permit? <br />Attorney Rautenstraus advised this would be <br />for a retaining wall only - no structure. <br />They must obtain a building permit but would <br />not be subdividing the property. <br />
