<br />City Council <br />Meeting Minutes <br />May 5, 2009 <br />Page 9 of 12 <br /> <br />RESOLUTION No. 17, SERIES 2009 - A RESOLUTION APPROVING A <br />REQUEST FOR A SPECIAL REVIEW USE TO ALLOW AN OUTSIDE PATIO <br />DINING AREA AT THE ENTRANCE OF AN EXISTING RESTAURANT (BEEF <br />O'BRADV'S), LOCATED AT 585 SOUTH BOULDER ROAD <br /> <br />Mayor Sisk requested a Staff presentation. <br /> <br />Planning Director Wood explained the applicant, Village Square "BOB", Richard <br />Womack, has applied for a Special Review Use (SRU) to authorize an outside <br />eating area. The outside eating area is proposed for the front and the east side <br />of the restaurant entrance. The intent of the applicant is to develop an outside <br />patio connected to the front of the restaurant for outside dining and drinking. The <br />applicant proposes to utilize the existing concrete flooring for the patio area and <br />fence the patio with a 3-foot high wrought iron fence. Planning Director Wood <br />summarized the proposal and it's conformance to the Special Review Use <br />criteria. The Planning Commission approved the Special Review Application and <br />recommended approval with one condition, that the SRU will be applicable to <br />Beef '0' Brady's only. The Planning Commission held a public hearing on April <br />15 and unanimously forwarded a recommendation of support with the following <br />condition: 1) The SRU is granted to the applicant only and may not be <br />exchanged at the time of sale. <br /> <br />APPLICANT PRESENTATION <br /> <br />Richard Womack, Owner of Beef 'O'Brady's, explained the restaurant has been <br />open for 150 days. His goal was to try to make a positive impact on the <br />community and since their opening they have raised $6,000 for little league <br />teams and non-profit organizations and they will continue to support the <br />community. Another goal was to revitalize the Village Square Shopping Center <br />and to date four new leases have been signed. He praised Louisville as a <br />wonderful city and recommended Council keep the hometown feeling. <br /> <br />Mayor Sisk asked if Mr. Womack agreed with the condition that the SRU would <br />be applicable to only the applicant. Mr. Womack agreed to the condition. <br /> <br />Mayor Sisk requested public comment. There were no comments. <br /> <br />COUNCIL COMMENT <br /> <br />Councilor Dalton asked when Mr. Womack began the Special Review Use <br />process. Mr. Womack estimated the process started two to three months ago. <br />Mayor Sisk noted the application was received by the City on March 23. <br />
