<br />9/21/82 <br /> <br />Page -5- <br /> <br />Councilman Cummings <br /> <br />What the only recourse would be for the <br />City if the developer did not meet the <br />road improvements in a timely manner. <br />Rupp commented to shut down the development, <br />and use the financial guarantees to do as <br />much of the improvements as funds are available. <br /> <br />Councilman Cussen <br /> <br />Commented he would be willing to be flexible <br />with Mr. Hartman; however expressed concern <br />with the improvements. Inquired of Mr. Hart- <br />man if he could present some options to <br />Council. <br />Mr. Hartman's reply - no. <br />He further stated that perhaps there was <br />a misunderstanding with the agreement - he <br />would be required to submit financial guaran- <br />tees for all the improvements when the 13th <br />family unit was constructed. <br />He spoke to the sidewalk and gutter torn <br />out at Jefferson and Hutchinson St. - stating <br />this was in the street right-of-way and it <br />was his impression this was done at the <br />request of the City. He further stated this <br />was done at their expense and would be re- <br />placed at their expense. <br /> <br />Councilman Leary <br /> <br />Inquired of Mr. Hartman are the improvements <br />for anyone living in a dwelling has a paved <br />street, is that correct? <br />Hartman replied that was correct. <br />Leary then asked if the amendment was approved <br />would Mr. Hartman make it available to any <br />potential buyer so that they would understand <br />exactly what the improvement schedule is? <br />Hartman said they would be willing to do this. <br />Councilman Leary asked if any people outside <br />the subdivision, living in the area were <br />effected by the lack of improvements at this <br />time. <br />Director Rupp advised that they were not. <br />He also commented they preferred that Jefferson <br />St. have a gravel base so that West St. would <br />not be the only access from the subdivision, <br />and Mr. Hartman had agreed to do this. <br /> <br />City Engineer Blanchard advised regarding <br />the removal of the curb and sidewalk at <br />Jefferson and Hutchinson - Carol Baker <br />was the prior owner of the property and one <br />of the requirements at that time was that <br />a pipe be installed over the Mayhoffer Ditch. <br />In order the control the flow line of the <br />ditch and accomodate the required size of <br />
