David K. Howard, 5909 E. 38th
Denver, CO

Councilman Leary

7/20/82

Page -7-

Height of the structure will be 27 ft.
One concern staff had was the appearance
of the structure from the highway. Public
Service Co. has made sincere efforts to
help mitigate the appearance with landscaping.
Lanterman advised there is no subdivision
agreement as there are no public improvements
required on the project. Planning Commission
unanimously recommended approval for the
special review' use and the final plat.

Ave.
Introduced himself and stated he was land use
supervisor for the Public Service Co. Larry
Keith, Landscape Architect was also in atten-
dance to answer any of Council's questions.

Inquired of Administrator Wurl as to the
status of speaking with Public Service Co.
about the joint access on the top of the
hill. stated
Administrator Wurl/it was his opinion that
Mr. Tanaguchi had been in contact with
Public Service Co. on this issue, as well
as a representative from the LDS Church.

Mr. Howard stated that he was present at
the Planning Commission the evening Neodata's
proposal was presented and the statement
was made that they had no response from Public
Service Co. This is his responsibility and
he handed Mr. Tanaguchi his card and stated
he did not appreciate the insinuation that
they were not responding, wished to know
whom he had contacted. The Company had
had a phone call from Mr. Tanaguchi but
there was no follow-up on what was occuring.
Howard felt it was a good joint use - didn't
know of any reason Public Service Co. would
oppose the access providing they could see
a plan that would not jeopardize their trans-
mission system. As long as there was ade-
quate clearance from any of their structures
the Company w'Ould be happy to entertain a ]oint-
use of their transmission right-of-way. This
was their official position on this.

Administrator Wurl advised it was his opinion
that Tanaguchi had written to the LDS Church
representatives requesting that they join
with Neodata's request to the Public Service
Co.
