<br />CONCERNED CITIZENS WISHING <br />TO SPEAK ON NEODATA ISSUE <br /> <br />6/15/82 <br /> <br />Page -8- <br /> <br />Those subject matters that had been discussed <br />dealt with the landscaping plan, phase II <br />improvements to South Boulder Road, and dedi- <br />cation of open space, etc. as outlined in the <br />subdivision agreement. The recommendation of <br />the Planning Commission was for approval with <br />the following conditions: First that there <br />be joint access with Neodata and the LDS <br />Church property which is to the east, but <br />divided by a 75 ft. Public Service piece of <br />property.. This is to be explored as fully <br />as possible and implemented in the subdivision <br />agreement if joint access could be worked out. <br />The second aspect was they would like to high- <br />light the road improvements which are to <br />occur on or before June 15, 1983. The last <br />point was that City Council review the good <br />faith effort Neodata has made with the neigh- <br />borhood associations relating to landscaping <br />prior to approval. The plat meets all the <br />technical requirements of the subdivision <br />ordinances and recommendation is for approval. <br />Mr. Ken Tanaguchi, Architect for the project <br />was present to answer any questions. <br /> <br />Mayor Meier advised that 4 people had signed <br />up to speak on this issue and requested they <br />limit their comments to 4-5 minutes. <br />He also requested that Attorney Rautenstraus <br />advise the audience of what action was being <br />taken by the Council this evening. <br />Attorney Rautenstraus advised that as at the <br />Planning Commission meeting, the resolution <br />only dealt with the subdivision plat - zoning <br />was a separate issue. A subdivision agreement <br />had been prepared as part of the process, <br />dealing with public improvements, the timing <br />of those improvements, sureties required by <br />the City of a developer. The subdivision is <br />with the current property owner - B.S.C.S. <br />Neodata as the applicant has provided a <br />separate agreement to the City relative to <br />landscaping improvements in the amount of <br />$160,000.00, and will post a performance <br />bond in this amount within 10 days of the <br />agreement, which will continue in effect <br />after building permits are issued. If, <br />however, no building permits are issued with- <br />in one year then they will be able to with- <br />draw the performance bond. <br />
