The intent was <br />two-fold - first to provide an explicit <br />means of being able to vote on an issue <br />if a relative is involved, and insure that <br />the person with a conflict does not par- <br />ticipate in policy making of the City. <br /> <br />Mayor Meier <br /> <br />Moved in section 3 of the ordinance "unless <br />reques ted to do so the word mernber(in lieu of <br />majority) present on said City Council, <br />Board or Commission." Seconded by Council- <br />man Leary. <br />Question called for. Vote: <br />YES: Heier, Cussen, Morris, <br />Cummings, Fauson <br />NO : Le~ary <br />Motion carried 5-1. <br /> <br />Mayor Meier <br /> <br />Referred to Section K of the Code of Ethics <br />Ordinance #699. <br />Mayor Meier moved, Councilman Cummings seconded <br />that Ordinance #699 be amended deleting <br />Section K. <br /> <br />Councilman Fauson <br /> <br />Concurred with Mayor Meier this section <br />should be deleted - stating that some of <br />the councilmern~ers that have dealt with <br />various issues in the past, such as the <br />Centennial Valley Mall, could be called <br />on for their experience and knowledge <br />at that time and it was his opinion it <br />would be unfair if they would not be allowed <br />to comment for two years after being voted <br />out of office. <br /> <br />Councilman Leary <br /> <br />Commented in his op~n~on the entire section <br />need not be de:leted to correct the problem. <br />Suggested it be rewritten for clarification. <br /> <br />Mayor Meier <br /> <br />Requested Attorney Rautenstraus to reword <br />this section of the Ethics Code and to <br />include it with the amendment to Ordinance <br />#734 on second reading. <br />Mayor Heier then withdrew his motion and <br />Councilman Cun~ings withdrew his second. <br />
