<br />COUNCIL COMMENTS <br />Councilman Fauson <br /> <br />Councilman Leary <br /> <br />Mayor Meier <br /> <br />LAW SUIT - SU~10NS & COMPLAINT <br />RICHARD BIELLA <br /> <br />ACCEPTANCE OF CITY ATTORNEY'S <br />REPORT <br /> <br />CITY ADMINISTRATOR'S REPORT <br />DRCOG - SCHEDULE <br /> <br />KAHAN/HOMART FUNDS <br /> <br />2/16/82 <br /> <br />Page -6- <br /> <br />Inquired of Mr. Bellock who was required <br />to post the signs on the project. <br />Bellock replied he was. <br /> <br />Stated he was going to oppose the resolution <br />because the access plan on South Boulder <br />would be a disaster, and quoted criteria <br />from the comp plan. It was his opinion this <br />P.U.D. violated the concept of this criteria. <br /> <br />Inquired of Director Rupp if the comp plan <br />criteria was applicable to Mr. Bellock's <br />P.U.D. plan. <br />Rupp replied Bellock would be entitled to <br />access to his property and he would be re- <br />quired to obtain a curb cut through the <br />Engineering Dept. They have criteria to <br />be followed for curb cuts and it would be <br />their decision to approve or deny the curb cut. <br />It was his opinion that the comp plan criteria <br />would not be used. <br /> <br />Mayor Meier asked for a <br />the motion. <br />YES: <br />NO: <br />Motion carried <br /> <br />roll call vote on <br /> <br />Fauson, Meier, Cussen, Morris <br />Ferrera, Leary, Cummings <br />4-3. <br /> <br />Attorney Rautenstraus distributed Summons <br />and Complaint Law Suit to the Mayor and <br />Council members that had been filed of this <br />date (February 16, 1982) and advised if <br />any of the members had questions, they could <br />contact him at any time. <br /> <br />Councilman Fauson moved, Councilman Cummings <br />seconded the City Attorney's report be accepted <br />and placed on file. Question called for. All <br />in favor. Motion carried 7-0. <br /> <br />Mr. Wurl stated DRCOG was contacted to make <br />a presentation to the Council on population <br />alternatives, they had a conflict for this <br />meeting but have confirmed they will be present <br />at the March 2, 1982 meeting. <br /> <br />The Historical Commission and LDC - Downtown <br />Revitalization letters were the only two <br />received, and it was Administrator Wurl's <br />recommendation that council defer action <br />until their March 2nd meeting to allow for <br />ample opportunity for other organizations <br />
