Councilwoman Morris 2/2/82 Page -13- Expressed her displeasure of rece1v1ng mater- ial on the evening of the meeting without an opportunity to review them thoroughly. Administrator Wurl apologized for this delay but was unaware the procedure was not pro- per until he had received Mr. Kurtz-Phalen's call late in the afternoon. At Councilman Leary's inquiry, Attorney Rautenstraus advised that he had reveiwed the amendment and since it did not involve the City saw no problem with their ratifi- cation. Councilwoman Morris reported she would go along with Attorney Rautenstraus' recom- mendation because she trusted him. RATIFICATION AUTHORIZED ~CEPTANCE OF CITY ~..iPORT COUNCIL COMMENTS Councilman Leary moved, seconded by Council- man Ferrera that Council ratify the First Amendment to the Superior Interchange Agree- ment. Question called for. All in favor. Motion carried 6-0. ADMINISTRATOR'S Councilman Fauson moved, Councilman Ferrera seconded that City Administrator's report be accepted and placed on file. Question called for. All in favor. Motion carried. Councilman Fau.son inquired of Administrator Wurl if $77,000 had been received from the Jacobs/Kahan Co. Wurl advised it was received today. Fauson inquired how the money would be spent. Wurl advised he requested a letter be sent to Council outlining how the money would be spent by LDC, and submit it for the next council meeting. Councilman Fau.son stated after reviewing all the documents relative to the agreement, none of them stated. specifically whom would ex- pend the funds except at the discretion of the Council, a.nd discredited Marvin Sparn's letter. Wurl advised it was his opinion there was a misunderstanding regarding the funds for the POW WOW, a.nd this letter was sent to Council as an explanation.
