Location of Wells Amendment Production Apparatus Amendment Enforcement Amendment Councilman Fauson PUBLICATION AUTHORIZED RESOLUTION #7 - INDUSTRIAL REVENUE BOND CRITERIA Councilman Ferrera Councilman Leary 2/5/82 Page -5- Councilman Leary requested an amendment to section 17.64.070 (a) Location of Wells, to read "nor nearer than eight hundred feet from any school." Leary also cornnented in terms of location of the wells one of the criteria he would suggest is consideration of pipeline location, before the well is drilled. Attorney Rautenstraus advised that could be a major consideration when the Special Re- view Use Permit is submitted. Councilman Leary suggested "including re- taining pits" shall be placed in locations as specificially approved by the City be added to this section. Leary requested the word "health" and safety be added to section 17.64.080 on page 4. Requested clarification of the wording on page 3 - Permit fees - "payable within 30 days after each anniversary date of such permit, did this mean 30 days prior to the anniversary date or 60 days. Attorney Rautenstraus stated - not 60 days but within 30 days they must pay the $1,000. Councilman Cussen moved, Councilman Ferrera seconded Ordinance in 50 Regulating the Exploration and Production of Oil and Gas Within the City of Louisville and Requiring a Permit for Such Exploration and Production be published as amended. Question called for. All in favor. Motion carried 6-0. Attorney Rautenstraus read the resolution in its entirety. Remarked it was his opinion that #8 of the criteria relative to quality of life could be applied by #9 and should be deleted from the resolution. Commented he ~flOuld like to have this section included, but would like the wording to be changed from IIIdrastic" adverse impact on
