<br />11/5/81 <br /> <br />Page -9- <br /> <br />Councilman Brown <br /> <br />Requested a slide be shown of what would <br />be visible above ground when the drilling <br />was complete, and the well is producing. <br />McCoy showed what is called a "christmas <br />tree" which was a very low profile tank. <br /> <br />Mayor Caranci <br /> <br />Inquired what royalties would the City get. <br />McCoy stated he could not answer the question. <br />He did advise that in the counties the amount <br />is significant, but had no information re- <br />garding the cities. <br />Attorney Rautenstraus commented this would <br />be determ.ined by the location when the <br />special review' use is submitted. <br /> <br />Mayor Caranci <br /> <br />Councilman Brown <br /> <br />Inquired if the ordinance were passed this <br />evening, the company would present the <br />royalities to the city before drilling is <br />begun. <br />Attorney Rautenstraus advised this was true. <br />At the time of the Special Review Use the <br />company will be required to provide infor- <br />mation to the City relative to what the <br />financial benefit will be. <br />He also advised should the applicant be <br />granted rezoning this evening, but denied <br />the special review use, William & Associates <br />would have to return to Council and get <br />the property rezoned to RE by ordinance. <br /> <br />Inquired how the property would be maintained <br />if it was rezoned agricultural - would it <br />be it's natural state. <br />McCoy advised their company would maintain <br />the area pursuant to the City's requirements. <br /> <br />Michael Cussen <br /> <br />Newly elected councilman in Ward I inquired <br />if there should be any contamination of the table <br />water as a result of the drilling who would <br />be liable. He then requested that Mr. McCoy <br />to be able to address this when he returns <br />for the Special Review Use. <br />Me Coy advised he would do this. <br /> <br />Mayor Caranci aqked if there was anyone <br />opposed to the application - none. <br />Council comments - none. He then closed <br />the public hearing. <br />
