10/20/81 Page -5- and it was his opinion that STC has been a boom to the community, but was concerned with the timing and preferred that it be approved within our urban services area by DRCOG before approval of the annexation. Administrator Wurl remarked that histori- cally what has happened with our requests in the past to DRCOG and Boulder County for amendments to our plan is that they have been automatically turned down, so we were just going thru the process to be good neighbors. The City has applied for 3 amendments to the urban services area - two of the three have already been annexed and are not presently in the urban services area. Previously if we hadn't have annexed these areas, or had we waited for them to respond to our request to amend it, we would not have had any of the annex- ations. Councilman Fauson Stated that during the Planning Commission hearing, Mr. Jack Varra expressed some concern regarding his property, has this situation been addressed at all. Mr. Graham stated it had been and the pro- blems have been solved. Councilman Meier Referred to page 4 of the annexation agree- ment ifl5. Water Share stating that one share of Marshall water owned by STC would not be transferred to the City at this time. Attorney Rautenstraus advised that at the present time STC needs this water share for their operation of business Hr. Graham stated that all the water rights were transferred to the City with the original annexation, and this share was purchased after this and is used for irrigation purposes. He further explained the ditch water on the site is used for filling a pond for fire protection and irrigation of the recreation area. Councilman Meier then referred to item 14.
