OSAB Analysis <br />20. OSAB's role in this matter is governed by Louisville Municipal Code (LMC) Sec. 4.02.040. As such, <br />its role is to provide comments and make recommendations. Its comments and recommendations are as <br />follows: <br />21. 4.02.040. D - [P]rovide comments to the council and/or planning commission on <br />development proposals for land immediately adjacent to, or materially impacting, open space <br />lands; <br />A. The application proposes dedication of approximately 84 acres of additional open space <br />lands and an approximate 16.5-acre park land dedication. Planning staff analysis calculated the <br />minimum required public land dedication as approximately 40 acres (12% of gross acreage). The <br />proposal is well in excess of that required by the LMC. <br />B. Many of the public comments focused on a preference for significantly greater open space <br />and other public land dedications than proposed in the application. There appears no basis in <br />law for the city to require public land dedications in excess of what Applicant has proposed. <br />C. OSAB acknowledges the Applicant has increased the total open space dedications compared <br />to what was presented to OSAB at its May 11, 2022 meeting. OSAB does not recommend that <br />either Planning Commission or City Council require Applicant to dedicate more than Applicant is <br />willing to do so. <br />22. 4.02.040 E. Provide input on the location of trails and paths on open space lands; <br />A. Considering the constraints of the GDP in place, the location of the trails and paths on open <br />space for the appears appropriate and consistent with previous recommendations of OSAB. <br />B. OSAB supports the planning staff recommendation regarding the design of the Campus Drive <br />underpasses, including upgrading the chain -link fence to corten steel fencing, LED lighting and <br />addition of a stone veneer headwall treatment with street name and City logo. <br />C. OSAB recommends that Applicant and Staff consider a third underpass for the trail that <br />intersects the proposed Rockcress Drive, applying the same design standards as recommended <br />for the underpasses along Campus Drive. <br />23. 4.02.040 H Provide recommendations as to how open space within the city's boundaries and <br />immediately adjacent thereto can best coexist with surrounding private land; <br />OSAB concludes that the open space dedications designated in the application are in sufficient harmony <br />with surrounding private land of both the Applicant and adjacent private land and consistent with <br />previous OSAB recommendations. <br />21. 4.02.040 1 Provide recommendations as to how the city can manage park and other land <br />adjacent to open space lands in a manner that best promotes the continued integrity of open space; <br />A. OSAB recommends that the City consider location of a dog park on publicly dedicated lands of <br />the Property. Said dog park should be within the jurisdiction of the Parks Division and not the <br />Open Space Division to avoid perceived management conflicts with open space mandates. <br />13 <br />
