His question was did the <br />City have anyway of enforcing these <br />convenants, or would it be best to <br />form a neighborhood citizens group. <br />Attorney Joss advised Mr. Shuster that <br />the convenants are prepared by the <br />developers and the City approves them. <br />However, since the City does not parti- <br />cipate in the developing of the coven- <br />ants they have no power of enforcement. <br />As a homeowner, Mr. Shuster does have <br />the authority to enforce the covenants <br />by filing an action in the District <br />Court to get an injunction against <br />the party at fault. <br />His suggestion to Mr. Shuster was that <br />a Homeowners Association be formed and <br />warn the party the association is <br />going to enforce these convenants and <br />if they do not comply, inform them <br />necessary action will be taken in court. <br />Mr. Shuster advised that the Louisville <br />Police Dept. was exceptionally cooperative <br />and prompt when they were called. <br />Mr. Shuster was advised to contact either <br />Attorney Joss or Ghief Leesman if he <br />had further problems and they would be <br />happy to see what could be done to <br />solve them. <br /> <br />MARK. PERSICHETTI <br />1402 Taft Place <br /> <br />He advised that he had heard on the <br />radio news that Louisville's water was <br />being contaminated from the Narshall <br />landfill seeping into the canal that <br />serves the City. He asked Council what <br />the situation was concerning this con- <br />tamination. <br />Administrator Wurl advised at the pre- <br />sent time no water is being used from <br />Marshall Lake. The City's solution to <br />this problem will be a direct pipeline <br />from Harshall Lake to our facilities. <br />
