<br />RESOLUTION NO. 29 CONT'D <br />STAFF REMARKS CONTINUED <br /> <br />COUNCIL COMMENTS <br /> <br />COUNCILMAN MEIER <br />COUNCIL VOTING <br /> <br />COUNCILMAN CARNIVAL <br />WATER RIGHTS <br /> <br />Minutes - page 6 <br />September 18, 1980 <br /> <br />In regards to the undemining questions, <br />Mr. Rupp stated that this would come up <br />at the time building permits are filed <br />on the property, and it would be than <br />that evidence would have to be supplied <br />as to the structures and activities that <br />would go on the property as being consis- <br />tent with wha.t the City undermining reg- <br />ulations state. <br /> <br />Mr. Rupp also noted that he had spoke with <br />the County Planner, County Connnissioner and <br />a Boulder Cou~cil member and it was noted <br />that the reason the Pow Wow was not allowed <br />was because of the inability to supply <br />the needed fa.cilities at the locations <br />desired. <br /> <br />Hr. Rupp reviewed the special use agree- <br />ment and also the list of activities to <br />be allowed. <br /> <br />Councilman Meier stated that in regards <br />to Mr. Leary's statment about the opinion <br />about Council voting, he noted that the <br />Attorney had received three interpretations <br />One stated that the City action of adopting <br />an ordinance by a majority of Council <br />present at the meeting was acceptable. <br /> <br />The second opinion stated that the City <br />vote was not acceptable. <br /> <br />The Attorney General's office stated that <br />they don't deal with these types of mun- <br />icipal issues on a one to one basis and <br />stated that the staff could have a session <br />with them if desired. <br /> <br />Councilman Meier also noted that he agreed <br />with the City Attorney's reconnnendation <br />that the ordinance in question be repub- <br />lished and acted upon again. <br /> <br />Councilman Carnival asked about water <br />rights and if the City would acquire any. <br /> <br />Dr. Marcotte stated that they would like <br />to keep a portion of their rights for <br />irrigation purposes of the land. <br /> <br />Councilman Carnival stated that he would <br />like to keep with the policy of the City <br />acquiring the rights and leasing them back <br />to the land owners. <br />
