RESOLUTION NO. 29 CONT'n WATER RIGHTS CONTINUED TRAFFIC CONTROL LAKE ACTIVITIES LANDSCAPING Minutes - page 7 September 18, 1980 Mr. Wurl stated that when the property was annexed, it was with the understanding that when it was subdivided the water rights would be transferred with the City. Mr. Wurl note~d that since the land was to be kept agricultural and would need the water it would be feasible to keep them as they are. He also noted that the rights are of no great value to the City. Councilman Carnival stated that he would like to see the City acquire the water rights anyway and lease them back. Councilman Carnival asked if the letter from the Boulder County Sheriff's Dept. was confirmation for traffic and security control on site as well as on South Bldr. Rd. adjacent to the property. Dr. Marcotte noted that item 12 of the agreement provides for traffic control on and off the premises and security protection on site during major events. Off site traffic control to be done by off duty officers, sheriff's or reserve officers. Councilman Carnival if there has been any provision mad.e for left turn lanes and lanes adjacent to the normal flow of traffic for easy access onto the road when coming out of the facility. Mr. Sparn stated that the City will use the right-a-way for excel decel lanes, but have no jurisdiction over the south side of the road. Councilman Carnival asked if the City had permission for use of the lake for the activities listed with the agreement. Mr. Cliff Foster stated that it is his understanding that the use of the lake goes with the property owned by Mr. Wagoner. Mr. Wagoner stated that he owns 2/3 of the lake and it goes with the property, so could see no real problem. Councilman Carnival asked when the land- scaping would. be done. Dr. Marcotte stated that the agreement pro- vides a time frame and also states that a bond be supplied until completion .
