<br />Council Minutes - page 3 <br />May 6, 1980 <br /> <br />CITY ATTORNEY REPORT <br /> <br />AQUARIUS REPORT <br />JUDGE DANA DECISION <br /> <br />Attorney Joss reported that he has re- <br />ceived a decision from Judge Dana on the <br />Aquarius vs. City matter. Judge Dana <br />has ruled that the court affirms the <br />denial of the Aquarius rezoning appli- <br />cation. <br /> <br />ORDINANCE NO. 671 <br />MORRISON ANNEXATION <br />REQUEST SECOND READING <br /> <br />Attorney Joss read Ordinance No. 671 by <br />title only and noted that the Public Hearing <br />was held, on this ordinance, in April and <br />further action on the annexation request <br />was tabled. <br /> <br />Mr. Morrison gave a presentation on his <br />annexation request noting 14, five acre <br />sites, with City Water and septic systems <br />will be used. <br />Dir. Corom. Dev. Rupp stated that the City <br />continues to take the position that the <br />housing be clustered. <br />Council stated their feelings on the pro- <br />posed annexation. After discussion Council- <br />man DelPizzo moved that Ordinance 671 be <br />adopted with the development done as <br />presented by Mr. Morrison. Seconded by <br />Councilman Domenico. Roll call. <br />Ayes: DelPizzo, Domenico <br />Noes: Meier, Carancir Carnival, Fauson <br />Motion defeated. <br /> <br />TABLING ORDINANCE <br />NO. 671 & 672 <br /> <br />Mr. Morrison stated that he would like <br />to table this annexation request for <br />further study. <br /> <br />Councilman Meier moved that Ordinance No. <br />671 and 672 be tabled until further notice. <br />Seconded by Councilman Carnival. Motion <br />carried 6-0. <br /> <br />DEFERRED COMPENSATION <br />RESOLUTIONS TABLED <br /> <br />Councilman Carnival moved that Resolution <br />No. 13 and No. 14 be tabled until the <br />May 20, meeting. Seconded by Councilman <br />Meier. Motion carried 6-0. <br /> <br />Attorney Joss read Ordinance No. 680 <br />on second reading by title only, and <br />requested that Council amend the ordinance <br />as it was published in section 1, after <br />the legal description to read as follows: <br />"be and the same hereby is vacated; <br />reserving an easement on said property..." <br /> <br />ORDINANCE NO. 680 <br />ALLEY VACATION <br />SECOND READING <br />
