Council Minutes - page 3 May 6, 1980 CITY ATTORNEY REPORT AQUARIUS REPORT JUDGE DANA DECISION Attorney Joss reported that he has re- ceived a decision from Judge Dana on the Aquarius vs. City matter. Judge Dana has ruled that the court affirms the denial of the Aquarius rezoning appli- cation. ORDINANCE NO. 671 MORRISON ANNEXATION REQUEST SECOND READING Attorney Joss read Ordinance No. 671 by title only and noted that the Public Hearing was held, on this ordinance, in April and further action on the annexation request was tabled. Mr. Morrison gave a presentation on his annexation request noting 14, five acre sites, with City Water and septic systems will be used. Dir. Corom. Dev. Rupp stated that the City continues to take the position that the housing be clustered. Council stated their feelings on the pro- posed annexation. After discussion Council- man DelPizzo moved that Ordinance 671 be adopted with the development done as presented by Mr. Morrison. Seconded by Councilman Domenico. Roll call. Ayes: DelPizzo, Domenico Noes: Meier, Carancir Carnival, Fauson Motion defeated. TABLING ORDINANCE NO. 671 & 672 Mr. Morrison stated that he would like to table this annexation request for further study. Councilman Meier moved that Ordinance No. 671 and 672 be tabled until further notice. Seconded by Councilman Carnival. Motion carried 6-0. DEFERRED COMPENSATION RESOLUTIONS TABLED Councilman Carnival moved that Resolution No. 13 and No. 14 be tabled until the May 20, meeting. Seconded by Councilman Meier. Motion carried 6-0. Attorney Joss read Ordinance No. 680 on second reading by title only, and requested that Council amend the ordinance as it was published in section 1, after the legal description to read as follows: "be and the same hereby is vacated; reserving an easement on said property..."
