Minutes - page 4 May 6, 1980 ORDINANCE NO. 681 CONTINUED Councilman Caranci moved that Ord~ No. 681 ~~tbe adopted. Seconded by Coun- cilman Meier. Councilman Domenico stated that the City should still get a written agreement from the people in the County, on the west, that they will not come back and try to get a portion of the vacated land. Attorney Joss restated that there would be no grounds for them to do so. Motion carried 5 - 1. Councilman Domenico voted no. Councilman Caranci moved that Ordinance No. 681 be adopted as amended. Seconde by Councilman Carnival. Motion carried 5 - 1 Councilman Domenico voted no. ORDINANCE NO. 677 MOUNTAIN STATES VIDEO FRANCHISE REVOCATION SECOND READING PUBLIC HEARING Attorney Joss read Ordinance No. 677 on second reading by title only, stating that the Ordinance was published in full on April 23, 1980 and notice of public hearing was published on April 23, and April 30, 1980. Mountain States Video was notifed of the hearing by Attorney Joss by letter dated April 22, 1980. Mayor Waschak opened the public hearing Attorney Joss reported that he has pre- pared a statement to be read into the record (SEE ATTACHMENT A) Attorney Joss also presented a letter from Jones Intercable and signed also by a representative of Mtn. States Video stating that they will not protect their interests through legal action. Mr. Wurl stated that it was his recommen- dation that Council act on the ordinance at this time. There were no audience comments for or against the ordinance. With no other comments Mayor Waschak closed the public hearing. Councilman Fauson moved that Ordinance No. 677 be adopted. Seconded by Coun- cilman Meier. Roll call vote. Ayes: Carnival, Fauson, Domenico, Caranci, DelPizzo, Meier. Motion carried 6-0.
