Seconded by Coun- <br />cilman Meier. <br />Councilman Domenico stated that the City <br />should still get a written agreement from <br />the people in the County, on the west, <br />that they will not come back and try to <br />get a portion of the vacated land. <br />Attorney Joss restated that there would <br />be no grounds for them to do so. <br />Motion carried 5 - 1. Councilman Domenico <br />voted no. <br /> <br />Councilman Caranci moved that Ordinance <br />No. 681 be adopted as amended. Seconde <br />by Councilman Carnival. Motion carried <br />5 - 1 Councilman Domenico voted no. <br /> <br />ORDINANCE NO. 677 <br />MOUNTAIN STATES VIDEO <br />FRANCHISE REVOCATION <br />SECOND READING <br />PUBLIC HEARING <br /> <br />Attorney Joss read Ordinance No. 677 on <br />second reading by title only, stating <br />that the Ordinance was published in full <br />on April 23, 1980 and notice of public <br />hearing was published on April 23, and <br />April 30, 1980. <br />Mountain States Video was notifed of the <br />hearing by Attorney Joss by letter dated <br />April 22, 1980. <br />Mayor Waschak opened the public hearing <br />Attorney Joss reported that he has pre- <br />pared a statement to be read into the <br />record (SEE ATTACHMENT A) <br />Attorney Joss also presented a letter <br />from Jones Intercable and signed also <br />by a representative of Mtn. States Video <br />stating that they will not protect their <br />interests through legal action. <br /> <br />Mr. Wurl stated that it was his recommen- <br />dation that Council act on the ordinance <br />at this time. <br /> <br />There were no audience comments for or <br />against the ordinance. <br />With no other comments Mayor Waschak <br />closed the public hearing. <br /> <br />Councilman Fauson moved that Ordinance <br />No. 677 be adopted. Seconded by Coun- <br />cilman Meier. Roll call vote. <br />Ayes: Carnival, Fauson, Domenico, <br />Caranci, DelPizzo, Meier. Motion carried 6-0. <br />
