Hawthorne, stated that
he is a resident of Mesa Point subdivision
and when his home was built there was a set back
violation and he had to adjust the size because
a variance was denied.
He stated that a variance request was just
approved in the subdivision, and the owners of
property in that area were not notified of
the request.

Mr. Hornbostel reqeusted that the matter be
returned to the Commission and notices be sent
to property owners in that area.

Dir. Rupp stated that the code allows for single
family variances to be handled administratively.
This request involving a front yard set back
where the house was built 2' into the front
set back, and staff agreed to have it heard
by the Planning Commission instead of deal-
ing with it.

He stated that the public hearing notice was
published in the newspaper and the required
notice was sent to the Homeowners Association,
but notices were not sent to homeowners.

After the hearing was held, the Planning
Commission approved the variance.

Eugene DiCarlo stated that he agreed that
when the matter is set for public hearing the
proper notices should go to the property
owners in the surrounding area.

Mr. Wurl stated that he agreed notices should
be sent to homeowners and that in the future
it will be done that way.

After discussion Councilman Meier moved that
the matter be referred back to Planning
Commission and notices be sent out to pro-
perty owners in that area. Seconded by Coun-
cilman DelPizzo. Motion carried.

RICK LUCE CABLE TV

Rick Luce, 187 Harper St., asked what the status
was with the cable television companies.

Mr. Wurl reported that the attorney is drawing
up two ordinances, one dealing with the existing
franchise and the other outlining Cable tele-
vision permits, which will be considered by
Council.
He stated that there have been four companies
interested in the City.
