<br />ORDINANCE NO. 623 <br />PUBLIC HEARING <br />CONTINUED <br /> <br />January 16, 1979 <br />Minutes - page 17 <br /> <br />In 1975 the plan was amended, it was also amended in <br />1976 very minorly. This was the major of the two. <br />Again to orient everyone, this is Highway 42, it <br />actually curves around right here. Highway 287 ex- <br />tends straight north now, we show just as realigned <br />as a conceptual realignment; the cemetery is right <br />here, the Aquarius land right in here. We have a <br />large map of that, but again the colored map be- <br />hind the Council illustrates this plan. The devel- <br />opment area is shown as industrial in this area, <br />the cemetery, the sewer plant, this plan provides <br />for the entire area between Louisville up to Hwy. 287, <br />and hopefully in Lafayette's case beyond Hwy 287, <br />the realigned Hwy. 287 to be open space. There is a <br />golf course designation right here; so the 1975 <br />plan also provides for this to be open space. <br /> <br />Now the Aquarius tract was annexed in the fall of 1976 <br />so both of these plans had been approved well prior <br />to the annexation request, so I don't believe there <br />is any doubt that the tract was indicated on both <br />plans as open space. It was zoned agricultural which <br />provides for 1 dwelling unit per 5 acres. I believe <br />the county zoning at that time was agricultural also, <br />but at one time this land was also zoned economic <br />development and I am not sure what the status was <br />when we rezoned it. I think more importantly the <br />posture of the County, at that time, was not to <br />approve any subdivision plats within the County that <br />had not been, well to approve any plats, and I think <br />that their record would hold that they have not approved <br />any plats, and I point that out because I think the <br />agricultural zoning that was granted this property by <br />the City provided more opportunity for development <br />then in reality existed while it was in the County. <br /> <br />Now, addressing the rezoning application itself, <br />the City has in its ordinance declaration of policy <br />for rezoning. I would like to read that section <br />of our code to you. <br /> <br />A. For the purpose of establishing and maintaining <br />sound, stable and desireable development within the <br />city, the rezoning of land is to be discouraged. <br />Rezoning should only be considered if: <br /> <br />1. The land to be rezoned was zoned in error. <br />and as presently zoned is inconsistent with the <br />policies and goals of the City's comprehensive plan. <br /> <br />I think the zoning granted this land,when it was <br />annexed in 1976 is consistent with the goals and <br />policies of the comp plan; and that the comp plan <br />specifically provides for this area to be Cemetery <br />and open space. <br />
