The area for which rezoning is requested has <br />changed or changing in such degree that it is in <br />the public interest to encourage a redevelopment <br />of the area. <br /> <br />I believe that the area around this tract has not <br />changed one iota in development form and certainly <br />I don't think we are talking about redevelopment <br />as you would in a core City area. <br /> <br />3. The proposed rezoning is necessary in order to <br />provide land for a community related use which was <br />not anticipated at the time of adoption of the City's <br />Comprehensive Plan, and such rezoning will be con- <br />sistent with the policies and goals of the Compre- <br />hesive Plan. <br /> <br />I don't believe that's the case. <br /> <br />4. The rezoning would only, I should say that the <br />end of #3 it says Or which means one of these sit- <br />uations should be met. <br /> <br />Or #4, the rezoning would only permit development <br />which, if evaluated as proposed annexation under <br />the annexation standards and procedures codified <br />in Title 16, would qualify for annexation. <br /> <br />To me that is a subjective question because when <br />the City annexed that land had they zoned it other <br />then agricultural it would have been in violation <br />of its comp plan and therefore the zoning and the <br />annexation itself may not have occurred. <br />I can't really say whether that would have happened <br />or not. I know it would have been staff recommendation <br />at that time that the annexation and zoning not occur <br />on any basis other then agricultural zoning. <br /> <br />I also believe that there are statutory criteria out- <br />lined for consideration of a zoning question, and <br />while the City Attorney can more indebt address these, <br />if necessary, these statutes refer to the character <br />of the district. Again, the character of this dis- <br />trict is agricultural and I don't think there is any <br />question about that. <br /> <br />2. The peculiar suitability for a use. <br /> <br />In this case, this land is suited for open space. <br />I believe it is also suited for a golf course and <br />certainly for cemetery development. <br /> <br />3. Appropriate use of land. <br /> <br />Within the context of our comp plan, the use of this <br />land for 7,000 square foot lot, single family <br />
