<br />OIL & GAS LEASE CONT'D <br /> <br />AGREEMENT WITH FIRST SAVINGS <br />INVESTMENTS <br /> <br />CODIFICATION <br /> <br />STATE LAND USE COMMISSION <br /> <br />CORRESPONDENCE <br /> <br />WATER STORAGE TANK <br />UPDATE <br /> <br />Roll call. Domenico yes, Caranci yes, <br />DiCarlo yes, McDonald abstained DelPizzo yes, <br />DiLorenzo yes. Motion carried. <br />Councilman Caranci requested an explanation <br />of Councilman McDonalds' abstaining on the <br />vote. <br />Councilman McDonald stated that if it is <br />the requeste of the Council as a whole, <br />she will vote, but felt since it will <br />affect her employer's financial status, <br />she sfelt that it best to abstain. <br />AFter discussion Councilman McDonald re- <br />quested that she receive some sort of <br />clarification from the City Attorney as <br />to what difficulties this would pose if <br />she did vote, if any. - <br /> <br />The agreement basically states that the <br />FSIC will receive the first revenues from <br />the well until their expenses are recap- <br />tured for the capping of the other well. <br />Councilman DiCarlo moved that the City <br />enter into an agreement with FSIC subject <br />to the City Attorney approval. Seconded <br />by Councilman DelPizzo. Roll call. <br />Domenico yes, Caranci yes, DelPizzo yes, <br />DiLorenzo yes, DiCarlo yes, McDonald yes. <br />Motion carried. <br /> <br />Mr. Wurl stated that the report was not <br />prepared; however, there were several <br />ordinances that needed to be reviewed. <br />He stated that the man from the codification <br />company will be meeting with the City <br />staff to discuss the codification. <br /> <br />Mr. Wurl stated that some minor changes <br />need to be made in the zoning ordinance <br />to incorporate what the LUC and City <br />compromised at. They will be prepared for <br />the next meeting. <br />The original amendments are going back to <br />the Planning Commission for there review <br />and recommendations and public hearing. <br /> <br />Mr. Wurl reviewed correspondence with <br />Council. <br /> <br />Mr. Noel Hobbs stated that the ground <br />test which were requested before the con- <br />tract with Western Empire Constructors, <br />was signed, showed that there were vari- <br />ations of the soil on the south end to <br />the center of the tank. <br />He stated that this would pose a problem <br />with the type of construction which was <br /> <br />-5- <br />
