<br />SIDEWALK IMPROVEMENT DIST. <br />CONTINUED <br /> <br />BROCK REQUEST <br /> <br />beginning any construction in the <br />event that they would like to put them <br />in themselves. <br />Schedule three includes the area near <br />the middle school. Mr. Wurl stated that <br />the City Engineer has spoken with the <br />school district and they are in agreement <br />to put in the sidewalks. <br />Mr. Wurl stated that the program is a <br />five year plan. <br />Councilman DelPizzo suggested that the <br />other parties who will be notified in <br />the near future maybe should be notified <br />earlier in case they can take care of <br />the situation now. <br />Mr. Wurl stated that a letter could be <br />sent, but there would be no way to enforce <br />it until that area comes up within the <br />program. <br />Councilman McDonald moved that the staff <br />be authorized to begin to advertise and <br />notify the proper persons on installing <br />sidewalks on their property. Seconded <br />by Councilman DiCarlo. Roll call. <br />DelPizzo yes, Caranci yes, DiLorenzo <br />yes, McDonald yes, DiCarlo yes. <br />Motion carried. <br /> <br />Mr. Wurl stated that a request from Mrs. <br />Brock was made to get a variance to sell <br />a portion of her property on Main St. <br />and Walnut St. Mr. Wurl stated that <br />under the subdivision regulations there <br />is a clause that under certain situations, <br />it is possible to be granted a variance <br />to divide property without subdividing. <br />Mr. Wurl stated that although Planning <br />Commission recommended to deny the re- <br />quest it was the staffs recommendation <br />that Council approve the request for a <br />variance. <br />Mr. Brock stated to Council that they <br />could have the property platted; however, <br />the survey shows that the property is <br />off several feet and to get the correct <br />boundaries, it would take the moving of <br />the entire area including the street <br />location; therefore, they felt it easiest <br />to pursue the granting of a variance. <br />After discussion, Councilman Caranci <br />moved that the request be denied. <br />Mr. Brock stated that there request is <br />within the Subdivision Regulations and <br />that they are not going against the <br />Ordinance. <br /> <br />-3- <br />
