<br />BROCK REQUEST CONTINUED <br /> <br />Planner Drumm read a portion of the <br />Subdivision Regulations, Article 5 <br />pertaining to variances, in regards to <br />unusual circumstances which Mr. Brocks <br />request fell under. <br />He also stated that there is no violation <br />of the zoning. <br />Councilman Caranci asked how the City <br />would stop people in the CBD from wanting <br />to sell their garages. <br />Mr. Drumm stated that it would be difficult <br />however, the downtown area is a commercial <br />type shopping area where you could have <br />small businesses; people would have to <br />have frontage on the propoerty they <br />wanted to sell. <br />Councilman McDonald asked if the struc- <br />ture in the area in question, if it was <br />presently working under City codes. <br />Mr. Brock stated that it was. <br />Councilman McDonald asked who was the legal <br />owner of the 6.6 feet behind the fence <br />that was constructed. <br />Mr. Brock stated that the fence has been <br />up for approximately 10 years therefore <br />it is his feeling that the property <br />still belongs to him since there has <br />not been enough time for adverse poss- <br />ession. <br />Councilman McDonald stated that she did <br />not fully understand the problem and felt <br />that there should be more discussion be- <br />fore a decision is made. <br />After comments Councilman DelPizzo se- <br />conded Councilman Caranci's motion to <br />deny the request. Roll call vote <br />was taken. MCDonald no, Caranci yes, <br />DiCarlo yes, DelPizzo yes, DiLorenzo <br />yes. Motion carried denying request. <br /> <br />KEITH HELART <br />PARKS & RECREATION <br />MINERS FIELD LIGHTING <br /> <br />Mr. Keith Helart of the Parks Department <br />explained to Council that Public Service <br />has checked the needed repairs of the <br />lighting and the parks deparment went out <br />and privately asked three companies for <br />bids. He stated that it was not put <br />out for public bid because not all <br />companies would be able to do the work <br />needed as recommended by the Public <br />Service report. <br />A question was brought up in regards to <br />the validity of the bids since it was <br />not called publically. <br /> <br />-4- <br />
