Mr. Robinson stated that the de- <br />velopers hire private geologists to <br />run tests, and he felt his staff and <br />himself were capable of determining <br />just how extensive the tests would need <br />to be on land. He stated that with his <br />knowledge his firm can make a fair re- <br />commendation as to land in relation to <br />subsidence. <br />Mr. Rogers stated that he felt a good <br />portion of the geologists feel that <br />subsidence will occur until all void <br />space is caved in. <br />Mr. Drumm asked Mr. Bucknam what is <br />the Land Use Commission going to do <br />about this type of professional dis- <br />agreement. If Louisville relys on <br />Mr. Robinsons' conclusion and the state <br />relys on CGS it will result in continous <br />court cases. <br />Mr. Bucknam stated that LUC would pro- <br />bably rely on the statements made on <br />the official arm of the state government. <br />Mr. Drumm asked Mr. Bucknam if Louisville <br />established its criteria with the <br />assistance of a professional geologist <br />and went out to a certain portion of <br />property and stated that the developement <br />met the Louisville criteria then the op- <br />tion is for the LUC to put Louisville <br />back in court because they would not <br />approve the criteria on that development. <br />Mr. Conarroe stated that he felt the <br />state should establish in writing the <br />guidelines they request communities <br />to follow instead of verbally making <br />statements and then changing them the <br />next time the topic come up. He stated <br />that the sooner the state comes up with <br />guide1ines the sooner the City can re- <br />solve the problem. <br />Mr. Donald Houlehan, attorney representing <br />Mizel asked Mr. Rogers and Mr. Robinson <br />why there was not some type of arbitration <br />board to resolve the differences such as <br />between the state and a private geologist. <br />He suggested that this type of board be <br />developed. <br /> <br />-6- <br />
