<br />HB 1041 - MATTERS OF STATE <br />INTEREST cont1d <br /> <br />Mr. Shelton stated taht Amuedo & Ivey did <br />the study not the state and the reason it <br />was designated as hazardous is theoretically; <br />the firm must have found it on an old mine <br />map. <br />Mr. DeMarco stated that the map that should <br />have been used is at the State Coal Mining <br />Commission as the last mining map before the <br />people removed themselves from that mine. <br />Mr. DeMarco stated that Mr. Andy Deborski, <br />Chief Mining Inspector and himself went over <br />the last map of the Fireside Mine and the <br />mine is 1,000 feet south of where the firm <br />placed it. <br />Mr. DeMarco stated that he could not believe <br />any other portion of the state map when he <br />was aware of a 1,000 foot error on his <br />property alone. <br />Mr. DeMarco stated that he has asked that the <br />correction be made and received a letter from <br />Mr. Cole admitting the error, but it was <br />never corrected. <br />Mr. DeMarco stated that in regards to sub- <br />sidence; when the mine caves in it forms an <br />arch and then it will not cave anymore. <br />Mr. DeMarco asked Mr. Shelton why when a developer <br />comes into Louisville to develop the Land Use <br />Commission and CGS come in and state that the <br />area may be a geologic hazard. He asked why <br />the state never told the farmer who may reside <br />on the property to move because the land may <br />subside. He stated that one is just as im- <br />portant as 1,000 people so why does the state <br />wait for a developer to come in. <br /> <br />Mr. Shelton stated that subsidence does occur <br />in coal fields. He stated that Amuedo & Ivey <br />did find areas sunk due to subsidence and <br />they spoke with farmers who would have to <br />level their fields because of subsidence each <br />year. Mr. Shelton stated that it is possible <br />for subsidence to occur when new land uses <br />begin, such as: changing ground water condi- <br />tions, vibrating the surface, etc. They type <br />of changes may cause subsidence. Mr. Shelton <br />stated that if the ground is perfect the arch <br />will form and stop subsidence, but there are <br />joints, faults, etc. that will cause sub- <br />sidence to occur. Mr. Shelton stated <br />that he did not feel the City should take on <br />a risk of future undevelopable land. <br />Mayor Waschak stated that in the late 1880ls <br />our families came in and built the City with- <br />out any tests for subsidence and the City is <br />still standing. <br /> <br />3. <br />
