<br />HB 1041 - MATTER OS STATE <br />INTEREST cont'd <br /> <br />Mr. Shelton stated that on the map it states <br />possible subsidence areas, but this does not <br />mean that there will be subsidence. The point <br />which is trying to be made is that detailed <br />studies should be made to pin point the <br />truly hazardous areas so they can be avoided. <br />Mayor Waschak asked Mr. Shelton if the state <br />is so interested why don't they run the tests. <br />Mr. Shelton stated that there are not those <br />type of funds. Mr. Shelton stated that the <br />developer would be the one to benefit and <br />should do the tests. <br />Councilman DiCarlo stated that he didn't feel <br />the tax payers should have to pay either, but <br />asked why after a creditable geological firm <br />does a detailed study the state questions it. <br />Mr. Shelton stated that the state spends little <br />time reviewing detailed studies but sometimes <br />has to do further detailed studies. <br />Mr. Greg Hobbs, of the Attorney Generals Office, <br />stated that what the state requests was suf- <br />ficient advanced planning before the tax payers <br />get involved with a development which may not <br />be suitable. He complimented the City on <br />their impact statements for annexation. He <br />stated that what the state asked is that the <br />developer make the needed studies for the <br />appropriate development on the land. <br />Councilman DelPIzzo stated that in regards <br />to the Mizel proposal the City complied with <br />the regulations put forth and then the Boulder <br />County Commissioners stepped in. He felt that <br />other communites would like to take in that <br />area. <br />Mr. Hobbs stated that the state would like <br />the zoning not to be applied until the <br />studies are done. <br />Mr. Wurl stated that the state was not the <br />only party disagreeing. He stated that the <br />County is asking for something different. <br />Councilman Berry stated that he felt HB 1041 <br />was not aSking for any more then the City has <br />asked for in the past on studies. <br />Mr. Wurl stated that the Citys concern was <br />if there would be an unwillingness on the states <br />part to accept the reports done by private <br />consultants and they turned out to be too <br />expensive for small developers. Mr. Wurl <br />stated to the Mayor and Council that building <br />could be a big factor before accepting the <br />plan map because it is possible that we <br />may want to put proposed development in areas <br />that are known to be safe and save the expense <br />of having to make detailed studies. <br /> <br />4. <br />
