<br />Mr. Drumm finished his presentation and Mayor Waschak then opened the public hearing. <br /> <br />Mr. Richard Hershy stated that he was completely lost and could not make comment if <br />he wanted to. <br /> <br />Mr. Percy Conarroe stated that on page 12 he did not understand the interpretation on <br />the water and sewage systems in regards to the building of new facilities and that there <br />would be hook ups to the existing plants. <br />Mr. Drunm stated that in his discussion with a L.U.C. staff member when speaking "New" <br />this would mean as if a new development had facilities to treat only their direct area. <br />What the City states is that it will serve all development in its planning area via <br />its existing treatment facilities so expansion and extension are valid however, they <br />are not contemplating building new water and sewer facilities now. Mr. Drumm stated <br />that several years from now Louisville may want to build new plants, if permission <br />can be got from the state then at that time this type of project could be disignated <br />as a matter of state interest. <br />Mr. Drumm stated that what is trying to be suggested is that the City take on as little <br />as it can now under the first initial input and still meet the requirements of L.U.C. <br />and the City needs as pertains to existing development proposals. <br /> <br />Mr. Conarroe stated that he did not understand what the objection would be to have the <br />new plant facilities listed in the guidelines now because at some future time it will <br />probably need to be done. <br /> <br />Mr. Drumm stated that it could be done with more expense and at this time it would not <br />really hurt anything to wait until a later date. <br /> <br />Mr. Conarroe felt that he was not sure would the outcome of this project would finally <br />be. <br />He also stated that the preliminary draft was a good solid approach of what the state is <br />requesting. <br /> <br />Mr. Mark DeMarco referred back to ghe geological surveys. He stated that he felt the <br />State would use the phrase "Geological Hazard" as a catch all to limit certain expansion <br />and annexation. He stated that the Colorado Geological survey and the Federal <br />Government have never drilled a hole to determine the extent of mines, it was always done <br />by private parties, however, by legislative fiat they state that an area is subject to <br />subsidence. Mr. DeMarco felt that this could be contested because they legislate this <br />but could not prove it because they deal strictly off maps and he felt this foolish. <br />He stated that these could be challenged. <br /> <br />With no further remarks Mayor Waschak closed the Public Hearing. <br /> <br />Councilman Berry referred back to Mr. Conarroes statement in regards to sewage and <br />water plants. He asked Mr. Drumm if it would be propoer to include in the draft <br />when new system were needed it would probably have to be declared an area of state in- <br />terest. Also, Councilman Berry felt that when the draft is final that the entirety be <br />forwarded to the Colorado Municipal League to keep them informed. <br /> <br />Councilman DelPizzo stated that Mr. DeMarco remark should be noted and the City should <br />contact the L.U.C. and ask for proof as to where the hazard areas are. <br /> <br />-4- <br />
