He wanted clarity on this. <br />Sisk stated that, if they are requesting rezoning, other issues such as open space needed to be <br />discussed. <br />Mayer stated that, if this is an implied rezoning, Council could not commit to that. <br />Bellock wanted, at a later date, to visit with staff and the City Attorney to find out if there would be <br />a way to create essentially blanket special use for this area as part of the PUD, which would then still <br />require the individual per lot approval. <br />Davidson asked the City Attorney research this. <br />Lathrop asked-what the commitment to improving 104th was on their part. <br />Bellock stated that their commitment at this point would be, at the phase appropriate to development <br />of 104th (when they develop the property adjacent to 104th), they would improve half of the collector, <br />street, that is the west half of 104th adjacent to their property. They were willing to pay their fair <br />share. <br />Lathrop felt this is the time to address the transportation problem in this area. <br />Mayer felt the types of uses being planned needed to be thought through as far as the sidewalk plan <br />for an industrial park and the sidewalk plan for offices. <br />Howard moved that Council move the Business Center at CTC on to the Planning Commission. He <br />asked the City Attorney to look at the zoning issue, if it should be rezoned. Seconded by Davidson. <br />All in favor with Keany being absent. <br />DISCUSSION/DIRECTION PRELIMINARY PLAT AND PUD THE PARK AT CTC <br />Paul Wood, Planning Director, stated that this application did not propose any additional right -of -way <br />dedication for Cherry Street or South 104th Street. <br />Davidson called for the applicant's presentation. <br />Terry O'Connor, O'Connor Development, 1600 38th Street, Boulder, Colorado, stated that they <br />may lose Key Product's contract due to the process delays. On the issue of open space there was a <br />difference of opinion between staff and the developers as to what the actual commitment was to open <br />space. He wanted to get this resolved. He pointed out that the lots they are currently trying to get <br />completed and improvements to are the ones on the west side which are touched by the wishbone <br />type road. He described the project including the boulevard type entry with trees along the road. <br />
