Planning Commission <br />Meeting Minutes <br />SEPTEMBER 10, 2009 <br />Page 7 of 10 <br />Staff has been working in conjunction with the Department of Public <br /> <br /> <br />Safety and the City Attorneys Office to draft an ordinance amending <br />certain sections of Title 17 of the Louisville Municipal Code (LMC) to adopt <br />regulations regarding Medical Marijuana Dispensaries. <br />The ordinance provides: a definition, a use group designation and <br /> <br /> <br />prohibits such uses as a home based business. <br />Use group 29a is proposed as an amendment to Section 17.12.030 of the <br /> <br /> <br />LMC and would permit a dispensary in Administrative Office (AO), <br />Business Office (BO), Commercial Community (CC), and Commercial <br />Business (CB). Such uses would not be allowed in residential, <br />Commercial Neighborhood (CN), Industrial (I) and Planned Community <br />Zone District (PCZD) zone districts. <br />Staff recommends approval of Resolution No. 10, Series 2009. <br />Commission Questions: <br />Sheets discussed with staff why the limitation to a home based business. <br />McCartney stated the dispensary of medical marijuana is considered a retail <br />business and retail businesses are not allowed in residential zone districts. <br />Therefore, it would not be a permitted home occupation. The inclusion of that in <br />the ordinance also came as a direction from the Police Department and the City <br />Managers Office. <br />Tengler asked if the dispensary required any special permitting. <br />McCartney stated it did not. They will be required to register the business with <br />the City of Louisville. <br />Tengler asked if the police thought there would be any security issues. <br />McCartney stated the police department did not see additional security issues <br />with a dispensary. <br />Pritchard stated he had no questions. <br />Lipton discussed the proposed use groups. He stated he supports not having a <br />dispensary in a residential area but there are some areas that are zoned PCZD <br />and CN that might still be appropriate for a dispensary. <br />Loo asked if the GDP’s would determine if a dispensary was permitted. <br />McCartney stated it might if a pharmacy is a permitted use. <br />Sheets asked what other communities have done regarding the regulations of <br />medical marijuana. <br />McCartney stated Boulder County has the highest percentage of medical <br />marijuana using patients in Colorado. Boulder, Longmont and Lyons already <br />have dispensaries. The City of Westminster has placed a moratorium on medical <br />marijuana dispensaries to allow staff time to investigate how other communities <br />are handling the dispensaries. <br />Members of the Public: <br /> <br />
