RESOLUTION NO. 11, <br />SERIES 2009 <br />A RESOLUTION RECOMMENDING AMENDMENTS TO CHAPTER 17.20 (OFF <br />STREET PARKING AND LOADING) AND CHAPTER 17.12 (DISTRICT <br />REGULATIONS) OF THE LOUISVILLE MUNICIPAL CODE, AS WELL AS CHAPTER <br />5 OF THE DOWNTOWN LOUISVILLE FRAMEWORK PLAN <br />WHEREAS, it is in the best interest of the City of Louisville to have parking <br />requirements that adequately meet the parking needs of the downtown area without <br />providing excess supply that can be detrimental to the unique character of the <br />Downtown area; and <br />WHEREAS, it is desirous to have a maximum allowable floor area in the <br />Westerly portion of Downtown Louisville which allows for growth in the area without <br />requiring extensive street infrastructure improvements; and <br />WHEREAS, City Staff has completed a parking study of downtown Louisville <br />which indicates that certain policy changes regarding parking requirements and the <br />maximum allowable floor area in the Westerly portion of Downtown Louisville are <br />appropriate; and <br />WHEREAS, comments on the proposed parking and downtown development <br />regulations were gathered through 5 meetings with the Business Retention and <br />Development Committee and 2 separate downtown stakeholder meetings; and <br />WHEREAS, after a duly noticed public hearing on November 12, 2009 where <br />evidence and testimony were entered into the record, including the findings in the <br />Louisville Planning Commission Staff Report dated November 12, 2009, the Planning <br />Commission recommends amending Chapter 17.20 (Off Street Parking and Loading) <br />and Chapter 17.12 (District Regulations) of the Louisville Municipal Code (LMC), as well <br />as Chapter 5 of the Downtown Louisville Framework Plan as follows; <br />Section 1. Chapter 17.12.060 of the Louisville Municipal Code, entitled "Maximum <br />floor area, Westerly portion of Downtown Louisville," is hereby amended to read as follows <br />(changes are underlined); <br />Sec. 17.12.060. Maximum floor area, Westerly portion of Downtown Louisville <br />Within the area designated as the westerly portion of Downtown Louisville, as defined <br />in chapter 17.08, the maximum floor area shall be 475, 000 square feet. No <br />development shall be permitted within the westerly portion of Downtown Louisville once <br />a maximum floor area of 475, 000 square feet has been achieved within such area.
