Prior to recordation of the PUD the applicant will obtain a deed of easement from the owners of Lot 13 of the Colorado Technological Center Subdivision, Filing :2 to construct improvements including a drainage culvert and rip rap on Lot 13. The development agreement will indicate that maintenance of these drainage improvements will be the responsibility of the owner of Lot 12. These documents will be recorded with the Boulder Coun1ly Clerk and Recorder. 2. The development agreement will contain language outlining the responsibility of the owner of Lot 12 to operate and maintain the two City owned, but privately maintained waterlines shown on the plans. 3. Prior to recordation of the PUD the applicant will dedicate the utility and access easement shown on the utility plan to the City of Louisville. Mayor Sisk requested an Applicant presentation. Carey Levy, President, Passc:o Companies Development LLC, 96 Corporate Park, Irvine, California stated he has worked around the country and expressed his extreme pleasure to work with the City of Louisville. Bob Van Pelt, RV Architec:ture, 4141 Arapaho Road, Boulder, CO; Home Address: 842 Trail Ridge Drive, Louisville, CO, stated the applicant accepts the recommendations of the Planning Commission and all the conditions of approval. MOTION: Councilor Muckle moved to approve Resolution No. 39, Series 2009, seconded by Councilor Clabots. All were in favor. Absent: Councilor Sackett. AUTHORIZATION FOR CITY MANAGER TO NEGOTIATE A LICENSE AGREEMENT WITH THE LOUISVILLE FARMERS MARKET FOR 2010,2011, AND 2012 Mayor Sisk requested a Staff presentation. Economic Development Director Star explained the Louisville Farmer's Market, LLC has requested sole use of the Steinbaugh Pavilion and surrounding area for a farmer's market for the ~~01 0, 2011 and 2012 seasons. With Council approval, City Manager Fleming will prepare and execute a license agreement with the provisions, which reflect the terms in the license agreement for 2009. . The market will have sole use of the property Saturdays from 7:00 AM - 4:00 PM from June 6 -- October 17, 2010 and comparable weeks during 2011 and 2012.
