The subdivision agreement has not been formalized, nor have the plat and
PUD been recorded. Since the approval of that plan, O'Connor Development has contracted with the
property owner to purchase the property. If approved, O'Connor will be acting as the subdivider and
will be responsible for the subdivision agreement and associated public improvements. The applicant
came forward in March 1998 to amend the back building from a single-story retail to a two-story
office building. The amount of parking on each lot is slightly short of CDDSG requirements;
however, the addition of an office building to this retail development should make the proposed
shared parking arrangement more functional. Several Planning Commission conditions remain
outstanding; however, the applicant has agreed to fully comply and staff is expecting that several
necessary plan revisions will be made by today.

Sisk called for the applicant's presentation.

Terry O'Connor and Greg Gastineau were available to answer questions.

Sisk called for Council comments and questions.

Howard commended the applicant on look of the proposed building.

Gastineau outlined the time frame for completion of the connecting road.

Lathrop asked Gastineau if he would have any objections to Council placing a condition on the PUD
that the connecting road be completed prior to issuing a certificate of occupancy.

Gastineau replied he would not have any objections.

Sisk asked Gastineau if the site originally intended for Boston Market will remain a drive-in restaurant
site.
