Headley <br /> <br /> Case Managers: Sean McCartney, Principal Planner & Gavin McMillan, Planner II <br /> <br />A request for approval of a preliminary subdivision plat and <br />♦ <br />preliminary planned unit development plan (PUD) for 390 acres <br />comprised of the above-described 310 acres of currently <br />annexed property and 80 acres requested for annexation. <br />Lipton reviewed the procedure for the public hearing as followings: <br />1) staff presentation <br />2) application presentation <br />3) public comment. <br />4) Commissioner questions of staff and applicant <br />5) Commissioner discussion and comments regarding the next steps with <br />possible continuance to a second meeting on February 25, 2010. <br />Lipton stated the meeting would conclude on or before 10:30 PM. He also stated <br />the public comment time would be limited to 3 minute per speaker. <br />Lipton reminded the audience the Planning Commission has no authority <br />regarding the annexation of property and requested any comments be directed to <br />City Council and not be a part of the discussion at this hearing. He continued by <br />stating the Planning Commission would take action on the zoning of the 80-acre <br />parcel being considered for annexation, the rezoning request of the 310-acre <br />parcel, the general development plan (GDP), the preliminary subdivision plat and <br />the preliminary planned unit development. Lipton requested the City Attorney, <br />Sam Light review the criteria for the rezoning request. <br />Light briefly discussed the criteria and then read portions of section 17.44.050 of <br />the Louisville Municipal Code. <br />Pritchard moved and Loo seconded a motion to enter into public record the four <br />(4) new public comments, the content of the ConocoPhillips binder, the 11 x 17 <br />plan sets, the City power point presentation slides and the ConocoPhillips power <br />point presentation slides. Motion passed by voice vote. <br />Public Notice Certification: <br />Schwertfeger reported the public notice for the initial zoning of 80-acres, the <br />rezoning of 310 acres, the general development plan in conjunction with the <br />rezoning request and the preliminary plat and preliminary planned unit <br />development (PUD) was published in the Camera on January 24, 2010. The <br />notice was also posted in City Hall, Public Library, Recreation Center and Courts <br />and Police Building and mailed to surrounding property owners on January 24, <br /> <br />
