STATUE DEDICATXON Steve Anderson informed Council that the Miners Statue has :aen installed and the dedication date has been set for January 8, 1977. CITY ATTORNEY REPORT MAYOPR SUIT Mr. ',url reported that the Mayhoffer suit is still scheduled for December 28, 1976. PIERCE BUTT Mr. Furl reported that Attorney Schroeder has all the information and has got an extension until December 27, '978. ORDINANCE #507 Mr. hurl, stated that the amendment per- ZONING ORD. AMENDMENT tains to day care homes and geologic hazard areas. Mr. wurl read Ordinance #507 by title only on second reading. Mayor Easchak opened the public hearing. Mrs. Gail Petz, 932 Main Street. She stated that she had recently bought the property for a possible child care center and she stated that she wasr informed that the amendment would allow centers in commercial areas. Mr. Drumm stated that the amendment does not allow for the centers in commercial arena. Sba stated that in talking with Mel Stephan, be understood the situation that currently they are not allowed, but with the passage of the amendment they would be. She stated that the facilities do have to be checked by the state health dept. Mr. Drumm stated that the reasoning be- hind the designation was that where you have children should not be near the heavy traffic areas, therefore making residential areas better. Mrs. Petz stated that it would be a parent drop off and pick up, there would not be any children walking to the center. Mr. Jun stated that he did advise the realtor on the property that the pro- perty should not be closed on until the matter had been finalized by Council. Mayor Jaschak closed the public bearing and referred the matter to Council for discussion. -3-
