tom"`• +.s YY.
 Burl
411
April 13, 1979
' Page 3
The agent for the sailer has promised to provide to me legal •
descriptions of the land historically irrigated, covenants to dry
up the land and evidence from the partnership documents that the
partners have been properly notified of the bona fide offer and
have failed to exercise their rights of first refusal. I have not
yet received these documents and closing is subject to my approval
of those documents when they are received.
The second contract on the agenda concerns the purchase of 15
shares of stock in the Leyner Cottonwood Ditch Company from Howard
eixler and Joan Sheley. The selling price is $500.00 per share which
in my view is a low price. However, the owners offered to sell the
water to the City at $500.00 per share and I obviously was not going
to disagree with their figure.
I urge the Council to approve both agreements. If any of the
Council members would like to discuss these agreements or any other
matter concerning the City's water system, I would be happy to meet
with them any time prior to the Council meeting. I prefer to handle
these questions beforehand on an attorney-client basis rather than
engaging in extensive discussion of market prices and water rights
strategy during the Council meetings. This makes it very awkward
for us in subsequent negotiations and we get too much information
and incorrect information in the newspaper articles.
Very truly yours,
MUSICK, WILLIAMSON, SCHWARTZ,
LEAVENWORTH a COPE, P.C.
D
By
tap en . _ aason
STW:no
enc.
ccs Mayor (w/enc.)
All Council Members (w/enc.)
Noel Hobbs (w/enc. )
