• Dave Stahl, Homsrt Representative, asked to
address Council regarding this proposal. Stahl
related to Council the terms by which this
subdivision was annexed in 1979 through
negotiations between the City of Louisville and J
R Louisville Associates and Hanover Development
Company. This land was annexed in conjunction with
Suitt. 1407 acres to the City of Louisville and
they jointly signed an annexation agreement
outlining specifics for land uses, i.e. number of
residential units that would be allowed on the
property, commercial square footage., office
square footage., etc.
Since then there have been several modifications
to the agreement including McStain' s Master Plan
and Homart's rezoning plan and development
agreement. The amount of commercial development
that this area can support is based on those
figures and the original annexation agreement , as
well as traffic counts, according to Stahl .
Homart will be analyzing its position as to
whether McStain 's proposal does adversely
impact Homart 's development agreement and zoning
agreement completed on April 17, 1984, and if it
does , to what extent Homart must then commit to
fulfill its obligations with respect to the
development agreement.
Stahl: ''Naturally none of these decisions will be
made until we go through the process, but I want
you to know, as you move through that process , we
will also be moving through there. I suspect
those decisions are unilateral."
W-470 REPRESENTATIVE
APPOINTMENT The City 's administrative staff recommended that
Council appoint a representative to the W-470 Task
Force, but delay payment of its share until the
Task Force acts upon the requested
additions/modifications.
The meeting dates and times were not available at
this time and concerned Mayor Maier as to the
availability of a Councilsember to attend. Also,
discussed was the necessity of policy decisions
and/or technical decisions.
It was ultimately decided that a Councilmesber
should be appointed for policy decisions and if
technical input becalm necessary , staff would be
available to attend.
8
