Bohr stated that Council would not want to
threaten the availability of water to anyone
within the City's corporate limits especially with
fomart having their infrastructure in place ready
to develop. W. do have an agreement (with
Superior) right now and if we are going to change
that agreement, I think we have to be very serious
about what our responsibilities are to our
citizens.'
Ballston stated that another thing that the Town of
Superior could offer to Louisville is the joint
upansion of facilities.
Anderson asked it anything has changed for the
City of Louisville since the time the original
Agreement was drafted that would prompt Louisville
to seek changes or be interested in dealing with
proposed changes at this time.
Rundley stated that the original Agreement was
entered into mutually by both parties with both
parties benefiting. Superior had a large part in
drafting that Agreement and was entered into with
considerable forethought. Bundiey feels that the
amended agreement is a major rewrite of the
original Agreement.
Referring to a statement by Ms. Rolston regarding
a letter sent to the Mayor of Superior, Hundley
stated that after some initial discussions with
Superior late in 1986 when they were considering
the Rock Creek Ranch project, he indicated in this
letter that instead of having to rely on a large
project like this to achieve a water system,
there would seem to be other avenues for Superior
to pursue such as a Community Development Block
Grant. The fact that the Rock Creek Project has
been incorporated into the Town of Superior adds •
different dimension than was originally there,
Rundiey stated, and on the basis of what was
submitted, Rundle)? advised Council that it doesn't
make any sense to entertain seriously the revised
agreement am it stands. If any alterations are
considered, they should be marginal.
Anderson stated that he has a problem with getting
into a counter proposal mode when in fact
Louisville did not solicit a proposal to begin
with. If there is a need for any changes, it
would have to be within the boundaries of
something that is possible. Anderson asked what
prompted Superior's proposed amendment.
B
