Wanush stated that it was staff's recommendation to <br /> postpone the collection of this fee and it is his <br /> recollection that Commission felt that other con- <br /> siderations were being made and that this fee would <br /> be appropriate to collect. <br /> Handley stated that as he recalled, Commission also <br /> felt that waiving the cash-in-lieu of would set a <br /> precedent and that other fees were either waived or <br /> postponed. <br /> Szymanski stated that from a land use standpoint, <br /> this is an excellent use of this land. "I would <br /> rather see this type of development than 47 units. <br /> I think the intentions of the applicant is providing <br /> a service much needed in this area. I like this <br /> idea very much. I think it is a special one time <br /> use situation and I don't believe we are setting <br /> any precedent here. I would even be in favor of <br /> amending it to postpone that cash-in-lieu of dedi- _ <br /> cation until future develop, same as the other <br /> postponements.* <br /> Mayor Fauson agreed with Szymanski stating that it <br /> is his opinion that each development should be <br /> considered on its own merits. "I think staff's <br /> recommendation that the cash-in-lieu of land may be <br /> collected if and when the additional development <br /> occurs on the property would be appropriate. " <br /> Rundiey stated that Councilman Scarpella asked that <br /> he convey his support of this subdivision and that <br /> postponement of the cash-in-lieu of land is <br /> appropriate considering the use. <br /> Anderson stated for the record that the applicants <br /> are aware of circumstances that may occur sometime <br /> in the future of the rerouting of 96th Street and to <br /> some magnitude may affect this piece of property. <br /> Mr. Wilson stated that this is a risk they looked at <br /> and are willing to go on with the project. <br /> Mayor Fauson moved that Resolution 025 be adopted <br /> with staff's recommended conditions which would <br /> postpone the 12% cash-in-lieu of land until such <br /> time that future development occurs on this pro- <br /> perty. Mohr seconded.
