All in favor. <br /> ORDINANCE NO. 1044, SERIES 1991 - AMENDING THE LOUISVILLE MUNICI- <br /> PAL CODE TO MAKE THE CITY CLERK POSITION APPOINTIVE RATHER THAN <br /> ELECTIVE IF APPROVED BY 'ihE REGISTERED ELECTORS OF LOUISVILLE, <br /> AND CALLING A SPECIAL ELECTION THEREON - 1ST READING - SET FOR <br /> PUBLIC HEARING <br /> Griffiths read by title only, Ordinance No. 1044, Series 1991, <br /> "An Ordinance making the position of City Clerk appointive rather <br /> than elective if approved by the voters of the City of Louis- <br /> ville, and calling a special election thereon. " <br /> Griffiths: I would like to answer one question that was <br /> raised at the last Council meeting. Council- <br /> woman Hornbostel asked what happens if this <br /> question of making the position of City Clerk <br /> appointive rather than elective was placed on <br /> the November ballot rather than a special <br /> election. If it passed, the state statutes <br /> provide that any measure making the clerk's <br /> position or treasurer's position appointive <br /> rather than elective must take effect in a <br /> manner so as to avoid shortening anyone ' s <br /> terms of office. If it was put on the Novem- <br /> ber election ballot and if it passed and if <br /> �_ there were candidates for the positions on <br /> the November election ballot then those <br /> persons elected would serve their complete <br /> terms prior to the time the ordinance took <br /> effect. <br /> Hornbostel: Would that be a two or four year term? <br /> Griffiths: It would be four year terms for the Treasurer <br /> and City Clerk. I was asked to draft the <br /> ordinance before you, the ordinance has <br /> three sections to it; first section makes <br /> changes to the Louisville Code that would <br /> make the City Clerk's position appointive; <br /> section 2 . on page two states those changes <br /> would not take effect unless a majority of <br /> the registered electors voting thereon at a <br /> special election voted in favor of making the <br /> position of City Clerk appointive; section 3 . <br /> calls a special election for August 6, 1991. <br /> If you chose to do so then I would just point <br /> out that given all the time requirements that <br /> exists in the Municipal election code the <br /> only date available to have a special elec- <br /> tion prior to the regular election would be <br /> 7 <br />
