<br />13.12.100 - Account in Name of Owner. All accounts for <br />water shall be kept in the name of the owner of the property and <br />not in the name of any tenant; provided, that persons holding <br />possession of property under a lease may be supplied on their own <br />account where the City deems it best to keep the account in the <br />name of the lessee. Such account in the name of the lessee shall <br />not diminish the responsibility of the owner for such water <br />charges. In addition, the City may require a deposit of at least <br />one estimated annual water rental or other appropriate amount, <br />which deposit may be retained by the City at any time when <br />payment of water rental becomes delinquent, and the City may also <br />require a new deposit before further service is rendered. When <br />service is discontinued, this deposit less any amount still due <br />the City for water service shall be refunded with interest at the <br />legal rate set by Colorado state statute. <br /> <br />13.12.110 - Bi11inq Procedure - Delinquent Payment - Pena1tv <br />- Water Turnoff. <br /> <br />A. The City shall bill all users in accordance with <br />monthly water service charges. The billing shall be <br />prepared and forwarded on a monthly basis. If any bill <br />is not paid wi thin thirty (30) days of the date of <br />billing, the account shall be considered delinquent. <br />If any account remains unpaid for a period of sixty <br />(60) days from the date of the billing, the account <br />shall be assessed a $3.00 late charge plus one percent <br />(1%) of the delinquent amount for each month or <br />fraction thereof the account is delinquent. The City <br />shall give the user a delinquency notice stating that <br />the bill must be paid within fifteen (15) days of the <br />date of notice or the water service may be turned off <br />and in no case shall it be turned on to the same <br />property until the delinquent bill and the late charges <br />have been paid in full. Once service has been discon- <br />nected for non-payment, a fee of Twenty Dollars <br />($20.00) shall be paid in order to turn the delinquent <br />service on during normal business hours and a fee of <br />Forty Dollars ($40.00) shall be charged in the event <br />service shall be turned on after normal business hours <br />of the City. <br /> <br />B. Change of ownership or occupancy shall not affect the <br />application of this section. <br /> <br />C. This section shall apply to users within or without the <br />corporate limits. <br /> <br />13.12.120. - Delinquent Rents Constitute Lien. All water <br />rents and rates, including late charges and penalties, shall be a <br />charge and lien upon the real property to which water service is <br />provided from the time said rents are due, and shall be a per- <br /> <br /> <br />- 2 - <br />
