DESIGNATION OF SMOKING AREAS <br />The proprietor or person in charge .ay designate a maximum <br />of fifty percent (501) of a public place or public meeting area <br />as a smoking area, except as follows: <br />(a) Lobbies, hallways or other co..on areas typically shared <br />by smokers and non-smokers .ay not be designated as smoking <br />areas, except that lobbies, hallw.ys or other common areas which <br />exceed f.ve thousand square feet (5,000 s.f.) in area may have <br />within them desJgnated smoking areas provided that no more than <br />twenty-five (251) of the total are. of such lObby, hallway or <br />common area is so designated and further providing that such <br />designate~ smoking areas are located such that it is not <br />ne~essary for non-s.okers to pass through such areas to reach <br />other no-smoking areas. . <br />(b) In restaurants with a seating capacity of twenty-five <br />(25) or 80re persons, the proprietor or person in charge shall <br />provide a no-smoking area of sufficient size to accommodate, <br />without unreasonable delay, patrons who request to be seated in <br />such an area. A conspicuous sign shall be posted on all public <br />entrances or in a pOSition clearly visible on entry into the <br />restaurant advtsin, patrons that such no-smoking area is <br />available. Without limitation, thl delay shall be deemed <br />reasonable if it is equal for s.okers and non-smokers. If ~ <br />waiting area is provided, such are. .ust .be a no-s.oking area. If <br />patron seating at such restaurant is directed by a restaurant <br />employee, such employee shall ask each patron for the patronls <br />preference for seating in a non-s.oking or smoking area. <br />(c) Public restroo.s may not be designated as <br />smoking areas for any reason. <br />(d) Where smoking areas are designated, existing phYSical <br />barriers and ventilation syste.s shall be used to minimize the <br />toxic effects of smoke in adjacent nonsmoking areas. <br />(e) Notwithstanding any other provision of this Ordinance. <br />any facility or area may be designated in its entirety as a no- <br />smoking area by the owner or manager thereof. <br /> <br /> <br /> <br />SECTION 5. SIGNS <br />To advise persons of the existenc. of -No Smoking- and <br />"Smoking per.itted- areas, signs with letters no less than one <br />inch high or symbols no less than three inches high shall be <br />posted as follows: <br />(a) The owner, lessee, or principal manager of a public <br />place where smoking is prohibited in the entire establishment <br />shall post a sign using the words -No Smoking- or the <br />international no-smoking symbol conspicuously either on all <br />public entrances or in a pOSition clearly visible on entry into <br />the public place. <br />(b) The owner, lesseei or principal manager of a public <br />place where. certain areas are designated as smoking areas <br />pursuant io this chapter shall post a sign using the words "No <br />Smoking Except in Designated Areas. conspicuously either on all <br />public entrances or in a position clearly visible on entry in the <br />public place. <br /> <br /> <br />2 <br />
