<br /> <br /> <br />On page two, there is an addition reciting the statues authorizing this agreement. <br /> <br /> <br />Superior deleted the requirement to rewrite their comp plan. <br /> <br />There was discussion on the phasing plan. The current plan allows for the construction of <br />1,500 residential units (65%) before any retail must be built. Council agreed on a phasing <br />plan of thirty-percent residential followed by thirty-percent retail before additional <br />residential could be built. <br /> <br />Discussion moved to the non-compete clause. It was felt that limiting the non-compete <br />clause to the suggested half-mile radius from the bridge was not acceptable. Council felt <br />the non-compete clause should apply to the entire city for both parties. <br /> <br />Final discussion centered on the terms of the agreement. It was agreed that the term <br />should be for seven years from the issuance of the first commercial building permit. <br /> <br />Review Legislative Agenda <br />Heather Balser reviewed proposed legislative issues for the January 4, 2005 legislative <br />breakfast. <br /> <br />Mayor Sisk reported that Representative Alice Madden will be proposing a tolling bill <br />that would allow local government influence on tolling proposals in their area and that an <br />allocation of tolling revenues remains in the corridor directly impacted. <br /> <br />Heather stated that it is rumored legislators will be discussing impact fees and 1041 <br />powers. She will monitor these issues. <br /> <br />Don Brown expressed concern about current water issues in Douglas County and <br />questioned whether it was possible that the state could make the rest of us pay for <br />Douglas County’s water woes. <br /> <br />Heather reminded Council that the Legislative Breakfast is scheduled for January 4, 2005 <br />at 7:30 am at Arts Center. <br /> <br />City Manager Items <br /> <br /> <br />Distributed pictures of Callahan trail progress before Thanksgiving snow <br /> <br /> <br />Distributed pictures of skateboard park taken today - Council questioned when the <br />park will be open. <br /> <br /> <br />2004 Capital Projects Not Completed – the information is not ready; suggested <br />that the item be reschedule for a January study session. <br /> <br /> <br />Senior Tax Rebate – The second reading of the ordinance is scheduled for <br />December 21. Council agreed that there should be a cap on the property value, <br />suggesting $300,000. The Finance Committee will be reviewing the ordinance <br />prior to the second reading. <br /> <br /> <br />Bill Simmons explained that staff met with representatives of the Colorado Tech <br />Center Metro District regarding their sewer service. The CTC Metro District <br />would like the City to participate in the $900,000 cost of moving the sewage lift <br /> 2 <br /> <br />
