However, as a <br />practical matter, it certainly does occur. <br /> <br />Cordell requested a five minute break. <br /> <br />Loeblich asked Helart if he had discussed his proposal with staff. <br />Helart replied that he had. <br />Loeblich asked staff if they supported the proposal for the vision clearance. <br />Johnstone stated that staff does not support the proposal of measuring the vision clearance area <br />from the alley center line. <br /> <br />Cordell requested motions to enter into record the documents presented by staff and Mr. Helart. <br />Loeblich moved and Weise seconded a motion to enter into public record those documents <br />presented by staff. Motion passed by voice vote. <br />Loeblich moved and Malmquist seconded a motion to enter into public record those documents <br />presented by the applicant. Motion passed by voice vote. <br /> <br />Public Present in Favor of Application: None heard. <br /> <br />Public Present in Opposition of Application: None heard. <br /> <br />Applicant Closing Comments: No additional comments. <br /> <br />Stat!Closing Comments: No additional comments. <br /> <br />Public Hearing Closed / Board Discussion: <br />Malmquist expressed concern with the proposed change from Mr. Helart regarding the vision <br />clearance measurement location. <br /> <br />Loeblich stated that he agrees with the comments from Malmquist and the fact that the Public <br />Works Department does not support the proposed change. He also supports the proposal from <br />staff to measure from the sidewalk and not the property line. <br /> <br />Cordell stated that he supports the proposal presented by Staff. <br /> <br />Weise stated that he is still concerned with the lot coverage but does support the variance with <br />the conditions of approval as detailed by staff. <br /> <br />Motion and Vote: <br />Loeblich moved and Malmquist seconded a motion to approval the garage variance request with <br />the following four conditions of approval: <br />1) The proposed garage shall not encroach into the vision clearance area; however, said <br />vision clearance area shall be measured from the back of the sidewalk rather than the <br />property line adjacent to Caledonia. <br />2) The proposed garage shall not exceed 480 SF. <br />3) The proposed garage shall be setback a minimum of 8 feet from the Caledonia Street <br />property line. <br />4) Reasonable efforts shall be made to preserve the existing mature tree in the northeast <br />corner of the property. <br />
