Board of Adjustment
Meeting Minutes
January 18, 2006

Johnstone stated that he was not aware whether it was legal to bike on sidewalks. However, as a
practical matter, it certainly does occur.

Cordell requested a five minute break.

Loeblich asked Helart if he had discussed his proposal with staff.
Helart replied that he had.
Loeblich asked staff if they supported the proposal for the vision clearance.
Johnstone stated that staff does not support the proposal of measuring the vision clearance area
from the alley center line.

Cordell requested motions to enter into record the documents presented by staff and Mr. Helart.
Loeblich moved and Weise seconded a motion to enter into public record those documents
presented by staff. Motion passed by voice vote.
Loeblich moved and Malmquist seconded a motion to enter into public record those documents
presented by the applicant. Motion passed by voice vote.

Public Present in Favor of Application: None heard.

Public Present in Opposition of Application: None heard.

Applicant Closing Comments: No additional comments.

Stat!Closing Comments: No additional comments.

Public Hearing Closed / Board Discussion:
Malmquist expressed concern with the proposed change from Mr. Helart regarding the vision
clearance measurement location.

Loeblich stated that he agrees with the comments from Malmquist and the fact that the Public
Works Department does not support the proposed change. He also supports the proposal from
staff to measure from the sidewalk and not the property line.

Cordell stated that he supports the proposal presented by Staff.

Weise stated that he is still concerned with the lot coverage but does support the variance with
the conditions of approval as detailed by staff.

Motion and Vote:
Loeblich moved and Malmquist seconded a motion to approval the garage variance request with
the following four conditions of approval:
1) The proposed garage shall not encroach into the vision clearance area; however, said
vision clearance area shall be measured from the back of the sidewalk rather than the
property line adjacent to Caledonia.
2) The proposed garage shall not exceed 480 SF.
3) The proposed garage shall be setback a minimum of 8 feet from the Caledonia Street
property line.
4) Reasonable efforts shall be made to preserve the existing mature tree in the northeast
corner of the property.
