The public hearing was closed. <br />Applicant Rebuttal: <br />Lisa Helm asked what Lowell Campbell's interest in this case was. He stated that he is a resident <br />of the City of Louisville. <br />Public Hearing Closed, Board Member Discussion: <br />Member Dinsmore <br />All that they are asking for is to build over an existing foundation. At some point when this home <br />was built along with that patio, was that not in conflict of the setback that we are talking about? <br />Member Shiker <br />Patios, as long as they are not a certain height, don't have a setback requirement like decks or <br />cement patios don't have to meet that requirement. Once they go above 30 inches, then you have <br />to comply with the setback requirements. <br />Member Campbell <br />Doesn't it have to do with the fact that they want to enclose the area, rather than just put a deck <br />cover on? <br />Ken Johnstone <br />Actually, if it were a cover, it also would be considered a structure.
