I guess the comment that I have basically are consistent with what the City Staff has found in a <br />sense that it's nice that they have the support of the neighborhood and things like that, but all of <br />those letters in support does not change our rules for meeting certain criteria. I'm in agreement <br />with the City. There are too many criteria that haven't been met to be able to grant it. <br />Member Menezes <br />I agree with Bev. We have to meet all of the criteria and I see that several are also not met and so <br />I think we're not in a position to approve it either. <br />Member Metsker <br />I agree with all of what the City has come up with. I don't believe it is the minimum variance. I <br />think 10 feet could be done instead of 12. I also see the applicant's point of view that they don't <br />want 2 feet of concrete hanging out there where they could decorate it with flowers or shrubbery. <br />But too many of the other criteria are not met at this point. <br />Member Brown <br />I would have to agree. As inoffensive as this structure appears to be, I would have to agree that <br />the first three criteria, specifically, are difficult to say that they are met. <br />Motion made to deny the variance to allow for a 21.9 foot rear yard setback where 25 feet is <br />required at 1911 Quail Circle. Motion seconded. <br />Roll Call Vote: Member Metsker, Yes; Member Menezes, Yes; Member Brown, Yes; Member <br />Campbell, Yes; Member Dinsmore, Yes; Chairman Shiker, Yes. Motion Approved 6:0. <br />B. Dorene Romero, 245 Spruce Street, Lots 8, 9, 10 and 11, Block 4, Louisville Heights <br />Subdivision - Variance to allow for a 19 foot rear yard setback where 25 feet is <br />required. <br />Staff Presentation of Facts and Issues: <br />Ken Johnstone gave the staff summary, stating the terms of the 6 criteria and how the applicant <br />has met those criteria. Johnstone recommended that this variance be approved with one condition <br />that no expansions are allowed on the north side of the house. <br />Board Disclosure: <br />All members visited the site, except for Don Brown. All members verified that they are familiar <br />with the property, had no contact with the applicant, nor do they have any personal interest in the <br />property. <br />5 <br />
