City Council <br />Meeting Minutes <br />October 2, 2023 <br />Page 7 of 14 <br />Mayor Maloney clarified the first motion is to pass the ordinance with an amendment to <br />implement on March 1, 2024. <br />VOTE: Motion failed on a 3-3 vote. Yes votes were Councilmember Hamlington, Mayor <br />Pro Tern Fahey, and Councilmember Dickinson. No votes were Councilmember <br />Hoefner, Councilmember Leh, and Mayor Maloney. Councilmember Most abstained. <br />ORDINANCE NO. 1859, SERIES 2023 — AN ORDINANCE AMENDING TITLE 17 OF <br />THE LOUISVILLE MUNICIPAL CODE BY CREATING A NEW SECTION 17.16.350 <br />ESTABLISHING PROCEDURES AND CRITERIA FOR A CONCEPT PLAN REVIEW — <br />2nd READING, PUBLIC HEARING (advertised Daily Camera 9/10/23) <br />Mayor Maloney introduced the item and opened the public hearing. <br />Community Development Director Zuccaro stated the City Council 2023 Work Plan <br />includes consideration of creating a Concept Plan Review process. This process would <br />provide an optional preliminary step in the development review process for initial non- <br />binding feedback for more complex applications prior to completing a full application. <br />This could help identify particular areas of interest or concern related to city policies, <br />plans and ordinances; it should not replace any City policies or standards for <br />development. Such a process may provide clarification on policy interpretation or <br />conflicting policy. <br />This process would be available to specific development types including General <br />Development Plans; Planned Unit Developments with multiple lots or height or density <br />waivers; Special Review Uses; Comprehensive Plan Amendments specific to a certain <br />property; and Zoning Map Amendments or Text Amendments specific to a certain <br />property. <br />The process is anticipated to take 1-2 months. Staff would not review for code or policy <br />compliance, but may provide summaries of plans, policies, and codes relevant to the <br />project. Applicant submits a narrative, preliminary plans, site data, information on <br />surrounding conditions, and character sketches. Public notice would be completed for <br />the Council meeting date. Council members have the opportunity to ask questions and <br />make comments individually but there would not be votes; additionally, Council should <br />not prejudge any part of the proposal. <br />Director Zuccaro reviewed some similar programs in other cities. The Planning <br />Commission recommend approval of the ordinance as drafted. Staff also recommends <br />approval. <br />Councilmember Dickinson asked why all PUDs are not included in this. Community <br />Development Director Zuccaro stated this process is for the lager more complicated <br />PUDs. The vast majority of single lot PUDs are meeting criteria or only asking for a few <br />
