Minutes - Page 6 September 20, 1979 Pickett: What was done was done and this is, as I see it, a completely different situation. Ross: Any further comments by the Board? No further comments? Okay, I make a motion that we either grant this variance or disallow the variance. Do you want to go ahead Steve since you're the acting secretary? Pickett: 1111 second that motion. Ross: There's been a motion made in second. Ferris: Frank Velasquez? Aye. Gil Reed? Aye. Don Ross? Absent. Don Pickett? Aye. Bob Davies? Two wrongs do not make a right. Aye. Robert Ross? Aye. So the motion is to grant the variance. DiCarlo: Thank you. May I make a comment? Ross: Go ahead. DiCarlo: Bob, I just want to make a comment on comments that you made and I don't believe that anybody on this Board has taken anything more into a character aspect. At least I don't believe that. I'm glad that Mr. Davies and Mr. Reed at least voiced their objections and their opinions. I will say one thing about Bob, Bob, you're right. So maybe the City did approach them. And so they told that, and I think that Steve can tell me if 11m wrong, the contractor was told that from that point on, he was continuing at his own risk prior to him even applying for a variance. If I'm right or wrong. I mean I just want to get the story straight. And the way the people felt, they were there that evening, and if they thought I was out of order no one said so that evening. I felt that a covenance has itls own merits and a contractor should surely be obligated to comply with that covenance, let along the ordinances in the City. I want to thank this Board, fortunately we have a good Board of Adjustment, and you guys do one hell of a good job. Thank you. Ross: Meeting is adjourned.
