<br />Board of Appeals <br />Page 3 <br />July 19, 1979 <br /> <br />requirements is a 24 foot garage. One of the requirements is a <br />four foot wide hallway. One of the requirements is a bedroom that's <br />large enough for me to maneover around in without obstruction. <br />When we have tried to make plans we've had to bear all these things. <br />The four feet in question is four feet out of my bedroom, and if we <br />have to go through a redesign process at this point in time it's not <br />only likely to cut down in the space that I need to maneover around <br />in, but it's likely to result in a significant delay of time because <br />we're going to have to go back and have all our plans approved again <br />by the Veterans Administration. I regret too that things have come <br />to this point, but if the variance isn't granted I'm going to be the _ <br />one thats going to be penalized by this. So I request that this be. <br />granted. Thank you. <br /> <br />Davies: <br /> <br />Thank you. <br /> <br />Bill Bachman: I'm the owner and the builder in question here, in <br />regards to the Councilman who came up and was refer~ng to the fact <br />that we continued building even though we knew that there was some <br />objections to it, in the fact that there was some problems. One of <br />the things was that the owners of the house, their V.A. loan had a <br />set amount of time to put this house up. If the construction wasn't <br />completed in that given time the money that he would have to put forth <br />would be increased, and I thought about this and I said to myself, <br />as the builder who was under contract to do this, that I just felt <br />that we should go ahead and get as far along as we could with it, that <br />I would take the consequences for it, if the variance wasn't granted, <br />but it was, we would be on schedule, we would be able to meet the <br />demands by the lender for this person, for the homeowner, and we would <br />continue it on schedule. Now if we don't get the variance, I'm not <br />going to sue the eity of Louisville or anytning like the Councilman <br />was might have said. I'm under contract to build a house at a certain <br />fixed price, I gave them~~ bid; ~~ to'~hat this house would cost, <br />and if there's delays on something that is as far as I'm concerned <br />arbitrary, then I would be liable for this thing, but since no one <br />had come up and said you cannot build this house, I just assumed to <br />go ahead and do it and try to meet schedule and build this house for <br />this person at the money that I said we could do it, and consequently <br />I think that I would hope that you would grant the variance for th~s. <br /> <br />Davies: <br /> <br />Thank you. <br /> <br />Anybody else? <br /> <br />Mark Bailey: 600 W. Hawthorne, across the street from the property <br />in question. There is certainly an unfortunate situation, I don't <br />know all the details and theres some difficult extenuating circumstances <br />that it just concerns me having just moved into the area, knowing full <br />well that the covenance were that sets a bad precendent with only by <br />my count 8 families living in the area of 100 some lots that are <br />already pending the convenance. Rules don't bend very well once <br />you've done it once it's easy to do it again, next time it could be <br />next door to me I suppose. I would ask you to deny the variance. <br />
