<br />Board of Appeals <br />Page 4 <br />July 19, 1979 <br /> <br />Davies: I would like to ask Mr. DiCarlo if that property is operated <br />under, and I may using the words rather badly, but P.D.D? Is their <br />a P.D.D. on those properties? <br /> <br />DiCarlo: <br /> <br />There was <br /> <br />Davies: Would you mind coming up to the desk there and let the people <br />just what that P.D.D. takes care of in space building sites, and the <br />like. <br /> <br />DiCarlo: As I recall the number of sites that were in the first track <br />of the Mesa Point Subdivision were somewhere in exce~s of 100 sites. <br />They did come under a preliminary P.D.D. , minimum lot size, they met <br />the requirements on minimum lot size, in fact in some cases they <br />exceeded, if I'm not mistaken, I think there was one, possibly three <br />lots, that were under it. But they did meet the P.U.D. <br /> <br />Davies: Now I would like to ask you Mr. DiCarlo, is there any restriction <br />of the building on that property, not this particular property but <br />any piece of property under the P.D.D? <br /> <br />DiCarlo: I believe that after a P.D.D. is granted, if there are any <br />decisions to move the setback or anything that has to brought to the <br />Variance Board. Otherwise they follow the setbacks. <br /> <br />Davies: In other words, we can look at a map, of a new area, and say <br />that these buildings will be on a line or on a curve matching the <br />street and all of them will be the same? <br /> <br />DiCarlo: All I'll say is that I'll follow the setback unless, granted <br />a variance by this Board. <br /> <br />Davies: <br /> <br />Thank you Mr. DiCarlo. <br /> <br />DiCarlo: Mr. Chairman, I would like to make just one remark to the <br />builder. I did not use the word sue, I just said there could be poss- <br />ible legal action. <br /> <br />Reed: The ordinances established for that area under this P.D.D. are <br />public knowledge as far as any setback requirements? <br /> <br />DiCarlo: <br /> <br />That's right Mr. Reed. <br /> <br />Reed: <br /> <br />And available at any time? <br /> <br />DiCarlo: <br /> <br />At any time. <br /> <br />Davies: <br /> <br />Thank you. <br /> <br />Don, do you have anything to say regarding this? <br /> <br />Ross: The pictures are the only view that I got from this lot, where <br />the house is, and the basement is already there right?
