Sigfried Patzer, the applicant, is asking for a variance from the <br />Louisville Municipal Code so as to permit the reduction of the <br />front yard setback from the required 25 feet to 23 feet 7 inches, <br />in order to leave on an upstairs overhang on the northwest corner <br />of the residence he is constructing at 612 Bella Vista Drive. <br />The overhang is violating Section 17.12.040 of the Louisville <br />Municipal Code which requires a minimum front yard setback of <br />25 feet. <br />C. Patzer makes his presentation. "This is a survey for the property. <br />From the property pins out in the street, the curb and gutter <br />will be put in as we go through the phase on that street. We <br />are 25.5 feet (from the front property line) to the foundation. <br />The foundation is in it's proper place. Even if this plan had <br />been drawn up before putting in the foundation, this dotted line <br />here, the overhang, would not be shown on this plot as an improve- <br />ment survey, because the improvement survey does not show any <br />overhangs or parts of that except the foundation. This is some- <br />thing that the improvement survey showed after the building was <br />up, or during the construction of the building. We have 14 <br />inches one way on the cantalever and approximately 30 inches on <br />on the other direction. That corner of the overhang is into the <br />setback. The man who drew the plot plan, myself as the contractor, <br />and the City, did not recognize this until it happened. That's <br />why I'm asking for a variance this evening. The corner of the <br />cantalever is the upstairs part of the house. The upstairs part <br />of it wouldn't work if it was cut off because the street does not <br />have a 45 degree parallel with the house, so it's an off corner <br />and if I go into that then I have structural problems with the <br />house. The only other thing I want to clarify is that the <br />foundation is where it belongs, this overhang was an oversight <br />on my and a few other people's parts". <br />1. Lee Bridgewater arrives at the meeting. He'll replace Don <br />Pickett, a regular Board Member who is absent. <br />a. Patzer explains to Bridgewater that they have an overhang <br />not foreseen by the man who drew up the plot plan, and <br />when he got the improvement survey, the upstairs floor <br />was already on with the upstairs corner of the house in <br />the setback. <br />2. Bridgewater wants to know if the 25.5 feet shown on the survey <br />is from the front property line to the foundation. <br />a.
